BOARD .OF ADJUSTMENT <br />FINDINGS, CONCLUSIONS AND ORDER <br />VARIANCE N0.48-86 <br />nDNm� m <br />JAN 9 1987 <br />CITY OF EVERETT <br />Pub'!c Works Dept. <br />Based upon the written request for a variance from the City's zoning code by: <br />Daryl Finley <br />21015 4th Ave. W. <br />Lynnwood, WA 98036 <br />hereinafter referred to as "Applicant," for a variance from E.M.C. <br />19.40.050(c) Rear Yards to allow: Construction of a single family residence <br />that would have a rear setback of 10 feet instead of the 20 feet allowed by <br />Code. <br />on the following a?scribed property <br />Lot 2 of Gentry S.P. # 10-85; Auditor's File No. #8605060048 <br />commonly known as: 5702 East Drive <br />The Board of Adjustment, following a public hearing on said application held <br />on January 5, 1987 and further having reviewed all testimony, makes the <br />following Findings, Conclusions and Order: <br />FINDINGS AND CONCLUSIONS: <br />That there have been exceptional or extraordinary circumstances or, <br />conditions applying to the subject property or as to the intended use <br />thereof that do not apply generally to other properties in the same <br />vicinity or zone. <br />Finding: The site is the middle lot of a three lot short plat and <br />has no frontage on a public street. Access is provided via a 20 foot <br />wide panhandle off East Drive that continues to the west to provide <br />an easement access to the rear lot of the short plat. <br />The lot length, at 110 feet, is considerably less than other lots in <br />the area, and in order to provide an adequate turn around and <br />entrance to the garage, which is on the front of the building, the <br />applicant is requesting that the rear setback be reduced to 10 feet <br />in order to leave 30 feet at the front for the turn around and <br />entrance. <br />Conclusion: There are exceptional or extraordinary circumstances or <br />conditions applying to this lot that do not apply generally to other <br />properties in the vicinity and zone. <br />2. That such variance is necessary for the preservation and enjoyment of <br />a substantial property right of the appellant possessed by the owners <br />of other properties in the same vicinity or zone. <br />Findifig: Surrounding property owners have lot sizes which are large <br />enough to provide adequate turn around areas on their own property. <br />Lot 2 is relatively small and if the variance is not granted, there <br />would not be adequate turn around area. <br />Conclusion: The variance is necessary for the preservation of a <br />substantial property right possessed by owners of other properties in <br />the area. <br />
