A hardship will be incurred by the Applicant if the <br /> variance is not granted because an irregular design <br /> structure will be placed within the building envelope on <br /> the subject property. This hardship is created by the <br /> small dimension of the building enve.lope of which the <br /> Applicant seeks to alleviate with the use of a <br /> variance. (Staff report) <br /> 8. The variance will not impact nor adversely affect the <br /> Comprehensive General Plan of the City of Everett. <br /> 9. The Everett Planniny Department has recommended appro�al <br /> of the variance fur the rear yard setback subject to the <br /> iollowing condition: <br /> 1. All requiced City permits shall be obtained from <br /> the appro,riate departments. <br /> CONCLUSIONS <br /> 1. The application :s foC the appro�-al of a variance for <br /> the reduction os the rear setback on property located on <br /> Lot 16 , Crastwood Plat, Edgemoor Lane, Everett, <br /> Washington. in particular , the request is for a <br /> reduction of the 20 foot rear yard setback to a six foot <br /> setback. <br /> 2. In urdez for a variance to be granted within the City of <br /> Everett the critecia as set forth in Section 19.70.060 <br /> Everett Municipal Code must be adhered to. The <br /> application satisfies that criteria. <br /> 3. Special circumstances exist for the granting of the <br /> variance. Special circumstances include the shape and <br /> dimensions of tt,e property and the irregular building <br /> envelope located on the lot. <br /> 4. The granting of the variance will not be detrimental to <br /> other properi:y owners in the vicinity. <br /> 5. The granting of the variance is necessary for the <br /> preservation and enjoyment of a substantial right of the <br /> Applicant that is possessed by the property owners in <br /> the area. That right is to develop the property in a <br /> manner consistent with the neighborhood and the <br /> Comprehensive Plan of the City of Everett. <br /> 6. The Everett Planning Department has recommended aoproval <br /> of the variance subject to conditions listed in Finding <br /> /9. <br />
