(Staff report, Cunningham testimony) <br /> ' 3• The subject lot is part of a subdivision that has been <br /> ` approved by the �ity of Everett. The lot vaciance is <br /> necessary because the placement of the b��.lding envelope <br /> within the lot is prohibitive to the lot's development. <br /> The south dimension of the building envelope is 14 feet <br /> if the rear setback standard of 20 feet is adhered to. <br /> With the requested variance, an additional 14 feet will <br /> be added to the south line of the building envelope for <br /> a 28 foot dimension. (Staff report) <br /> 4• Tn order for a variance �o be granted within the City of <br /> Everett, the criteria as set forth in Section 19.70,060 <br /> of the Everett Municipal Code must be adhered to. These <br /> criteria include: <br /> A• That there are er.ceptional or extraordinary <br /> circumstances or conditions applying to the <br /> subject property or as to the intended use <br /> thereof, that do not apply generally to other <br /> properties in the same vicinity or zones; <br /> B• That such variance is necessa.-.y for the <br /> preservation and enjoyment of a substantial <br /> property cight of the appellant possessed by the <br /> owner of other properties in the vicinity or zone; <br /> �• That the authorization of such variance will not <br /> be materially detrimental to the public welfare or <br /> injurious to property in the vicinity or zone in <br /> which the property is located; <br /> D- That the granting of such variance will not <br /> adversely affect the Comprehensive General Plan. <br /> 5• Because of the excessive frontage of the subject <br /> property and the limited depth, and, because of the <br /> restricted south dimension of the building envelope, <br /> special circumstances exist for the granting of the <br /> variance.
