Fleck was issued a Fire Marshal Order on December 8, <br /> 1982. That Order has not been complied with. Several Fire <br /> Code violations still exist in the buildings. <br /> If Ms. Fleck wishes to sell the property as a single family <br /> residence, it can be done. However, the Building Code <br /> violations should be corre^.ted even in this lesser occupancy <br /> state. <br /> If Ms. Fleck wishes to sell the property as a business, <br /> proper Zoning Code procedures shall prevail in determining <br /> use factors for the type of business being offered or, the <br /> Zoning Code shall negate any business on the property which <br /> is 2onec: R-2. <br /> In the event Ms. Fleck is granted, through the 2oning Code, a <br /> Special Property Use permit, the buildings on the property <br /> shall con£orm to all Fire Code and Building Code requirements <br /> and regulations periaining to such use of the buildings. <br /> Until such a time as it is determined that the property is <br /> sold as a single family residence or a business, I recommend <br /> that the City hold in abeyance for a period of six months, <br /> the requirement of makinq the necessary changes to correct <br /> Buildinq Code violations for a single family residence. <br />
