Criterion No. 6: The need for the requested variance is not the result of a self- <br /> created hardship. <br /> a. Findinqs: The applicant has stated that lhe requested setback <br /> variance is similar to those already appreciated by neighboring <br /> properties. The proposed variance is the minimum necessary to <br /> accommodate the single family residence while minimizing impacts <br /> to this legal lot. The lot slopes from south to north and is located <br /> approximately 20 feet above the street right-of-way of England <br /> Avenue. The garage is permitted outright with a setback of five feet <br /> from the front (northern) property line. The applicant is proposing to <br /> construct a deck feature on top of the 5arage to enhance the living <br /> space on site. <br /> b. Conclusions: The proposed residence is being located in such a <br /> manner�n site lo take into account the limited buildable area. Due <br /> to the topography changes on site, the requested variance is not the <br /> result oi a self created hardship. <br /> NOW, THEitEFORE, the Board of AdJustment of the City of Everelt does hereby <br /> order that lhe requested variance be APPROVED to allow for a deck to be <br /> constructed over the garage five feet irom the front property line. <br /> The action of the Board of Adjustment in APPROVING a variance shall be final and conclusive, unless <br /> within twenty-one (21) days from the date of decision an aggrieved person or persons obtains a writ of <br /> certiorari from tl�e Superior Court of lNashinglon for Snohomish County for the purpose of review of <br /> the action taken. <br /> DATED this 6"' day o(June 2005. �� <br /> I „�,�. ��, <br /> Chairman, Board of Adjustment <br /> Notes to Appiicant: <br /> 1. The developer will be required to supply the PUD with suitable <br /> locationsleasements upon their property for any underground <br /> electrical facililies thal must be installed to serve lhe proposed <br /> developmenl.
