Temporary erosion control measures for conslruction activity must be operational <br /> prior to commencement of any clearing or earthwork. <br /> 7. Permits are required for building construction and compliance with the state <br /> building codes. <br /> S. All work must conform with the Geotechnical Report prepared by Nelson <br /> Geotechnical Associates, Inc. dated June 2, 2005, including review and approval <br /> of grading, erosion control, drainage and conslruction drawings by the <br /> geotechnical en3ineer. <br /> 9. Representatives from Nelson Geotechnical Associates, Inc shall be on site and <br /> review proposed construction plans as recomniended in the`r report dated June 2, <br /> 2005. <br /> 10. The appiicanl must record a covenant that runs with the land waives claims <br /> against the City, ils o(ficers, employees and agents, and inden �,..as (including <br /> reasonable atlorney's fees), defends and saves the City, its officers, employees <br /> and agents harmless from any loss or damage to people or property either on or <br /> o(f the subject property resulting from any form of soil movement whatsoever <br /> and/or irom any form of failure in design and/or construction of the improvements <br /> thereon whatsoever. The owners of the subject property shall provide lhe City <br /> with the covenant and it shall be signed and acknowledged by all parties with an <br /> interest in the property. The covenant shall also provide notice concerning the <br /> presence of unconlrolled fili and environmentally sensitive features on the <br /> properly. The covenant must be presented to the Cily for review and approval <br /> and, upon approval, recorded by the applicant with the Snohomish County Auditor <br /> prior to issuance of any permits for the site. <br /> 11. Compliance with all other local, state and federal codes is required. <br /> APPEALS: Tliis determination may be appealed to the Land Use Hearing Examiner. <br /> Any such appeal must be fifed wilhin 14 days of the date specified below. Appeal forms <br /> are available from the Planning Department and must be submitted along with the <br /> required filing fee.
