The investor and investor's attorney refuse to pay the higher fee. The <br /> builder is being paid a flat fee of$10,000 per house to build so he has no ability or obligation to <br /> cover the difference. The shortfall �vould be my responsibility and I don't have the ability to <br /> cover it. I was instructed and informed by both jurisdictions that we would be paying the City of <br /> Everett for connections and working with them. I feel that the fair and right solution would be for <br /> the jurisdiction that will ultimately be collecting the connection fees to honor the instructions <br /> given and charge the City of Everett's rates that were quoted. <br /> Paine Field VVa��—This project is in a similar predicament. The bank is financing the <br /> construction as a way to eliminate vacant lot inventory by alloN�ing single build-outs. The bank <br /> required LXACT construction costs. Win Lessley with Adair Entetprises, LLC was instructed by <br /> Mukilteo Water& Sewer that he needed to work with Everett as they would be acquiring the <br /> �vater and sewer sen�ice August I, 2010. The bank refuses to pay uny overages on line items and <br /> Adair does not have the fi:iancial ability to cover the difference. The City of Everett not only <br /> issued pemiits October 13, 2010 based on this information but also collected the connection fees <br /> of both �vater and sewer(see uttached permits). Construction has now come to a halt as we need <br /> water to test plumbing. Interest charges continue to accumulate as the project sits idle. The City <br /> of�verett refuses to connect�vater and sewer even though they have already been paid for it due <br /> to this mix up. Up to this point the City of Everett has performed all inspections. <br /> Dunles on Corbin — t�9r. Messak (owner) also informed of the change coming and held off <br /> purchasing 2 �vater meters until August l, 2010. Mr. Messak still has no water and a completed <br /> investmcnt property sitting vacant. <br /> This issuc only affects the 3 above named groups. It is a very isolated issue. I would propose two <br /> simple alternatives solutions to this problem on these�,rojects only: <br /> I. If water is transferced to the Cit of Lverett January 1, 201 l, then <br /> a. 11�e will hold off on paying water until the first of the yeu and deal ���ith Everett <br /> b.
