Letter dated January 10, 1995, from Bethany Christian Assembly Regarding Parking <br /> Overtlow <br /> All of the exhibits are available for inspection at the Hearing Examiner's Office located at <br /> 2930 Wetmore Avenue, 8th floor, Everett, Washington. <br /> After due consideration of the testimony and evidence presented by the Applicant, <br /> testimony and evidence elicited during the public hearing, and as the result of the personal <br /> inspection of the subject property and surrounding areas by the Everett Hearing Examiner, <br /> the following findings of fact and conclusions constitute the basis of the decision of the <br /> Everett Hearing Examiner. <br /> FINDINGS OF FACTS <br /> 1. The Applicant requested approval of an expansion of a Non-Conforming Use Permit <br /> to allow a 1,008 square foot addition to an existing office building on the property <br /> located at 2601 Everett Avenue, Everett, Washington. The addition, a new office <br /> space in the existing structure, will be made to the non-conforming building. <br /> 2. The subject property is a 13,680 square foot parcel of land that is zoned R-4, <br /> Multiple-Family Density. On-site is a 4,032 square foot o�ce building and adjoining <br /> parking stalls. The proposed addition will result in the structure on-site being 5,040 <br /> square feet. <br /> 3. The building on the subject property is non-conforming because it is located in a <br /> Multi-Family Zone, but does not have multi-family dwellings in it. The building <br /> consists of office space only. As a result, the structure is non-conforming, and any <br /> additions must secure an expansion of the Non-Conforming Use Permit. <br /> 4. The property to the north is zoned R-2 and is developed with a multi-family <br /> structure. The property to th� south is zoned R� and is developed with multi-family <br /> structures. The property to the east has an R-4 zoning designation and is <br /> developed with a church, while the property to the west has an R-0 zoning <br /> designetion and is developed with single-family structures. <br /> 5. In order for a non-conforming use to be expanded, the criteria as set forth in Everett <br /> Municipal Code (EMC) 19.38.090 must be satisfied. These criteria have been <br /> identified in the'staff report which was admitted at exhibit#1 and reference is mede <br /> to these criteria. <br /> 6. The existing structure on the subject property was built in 1972. The structure has <br /> been used for o�ce space since the time of construction. <br /> 2 <br />
