` .
t•ir. Dennis Derickson
Page T4:o
January 11 , 1980
South roadw.av L. I .D. Following our discussiuns oL the
proposed South Lroadway L. I .D. , there do not appear to be
serious qustions. I believe that my clients will be
wiliing to pr.ovide a power of attorney authorizing the
formation of the proposed South IIroadway L. I.D. as explained
by the City staff. It is our further understanding that my
clients as propertv owners will retain all riglts to comment
— ---- —
upon (anc o ect to the benefit tn their property from the
1 p or posed improvementSp the pcoposed method of asse=sment,"
ancT -tproposed assessments to their property. In other
words, the sole ffect of the power oi attorney will be to
authorize the formation of the South Broadway L. I . D. and
will not ot-herwise prejudice the rights of my clients as
property owners to contest other aspects of the proposed
Soui-h Broadway L. I .D.
100th Street L. I .U. The City staf-f clarified that the
proposed t00th Street L. I .D. did not include the other
improvements to 7th Rvenue and other streets south of 100th
Street. Such questions and possible local improvement
\ ,- districts may iollow but my clients are not beinq asked to
; sign a po;er of attorney authorizing such additional
\ y- local improvement dstricts. Instead , the proposed 100th
y' Street L. I .D_ will be to simply improve the existing right-
/ of-way. As w constructed to provide access to the Country
` '. .
Club Apartme s. The City accepted the right-of-oay but not
, the improvements. The City believes that 100th Streel- must
be improved including curbs , gutters and sidesalks, t•io
lanes for traff-ic, and possible leL-t turn and/or parking
lanes within a 44-foot paved portion. My clients are not
cert-ain as to wheCher their pr.operty is benefited by the
proposed improvements to 100th St-reet. No final decision
was reached on the 100th Street L. I .D.
Future North-South Corridor L.I .D. After the stafL
explanation of the proposed North-South corridor, and
subsequent discussion , my c.lients have concluded that there
is clearlv no benefit to them f.rom the proposed L. I .D.
Irrespective of whether the North-South corridor. is estab-
lished on any of the three alternative rights-of-way, my
clients have concluded that they will not be benefitted.
tdoreover, inasmuch as their property does not front on at
12ast L-wo of the alternative courses, their consent as a
property oianer to such a tuture L. Z .11. is not necessary.
'Phus, my clients are unwilling to sign a power of attorney
athori.ing such a North-South corridor. at this time .
