WASIIINGTON <br /> RE: Everett Mall 8usiness Park 90:0� <br /> Our File No: 79-107 <br /> Your File No.: 1044-002 <br /> Dear Ed: <br /> Thank you for your letter of 7anuary 11, 1980 in which you requested clari- <br /> fication of a number of specific conditions contained in the "Final Declaration <br /> of NonSignificance" for the Cverett ivlall Business Park, and 1 apologize for <br /> the lengthy delay in responding to your questions. <br /> South Broadway L.I.D. - The City agrees with your conclusions. ` <br /> 100th Street L.I.D. - So that there is no misunderstanding, it should be <br /> pointed out that the L.I.D will include improvements to the intersection <br /> of 7th Avenue S.E. at 100th Street. <br /> The 100th Street improvement has been identified as a mitigation of <br /> significant traffic impact upon the street. The known benefits to +.he <br /> proposed development include safer vehicle and pedestrian usage and <br /> easier accessibility and convenience for employees and patrons of the <br /> development. <br /> Future North-South Traffic Corridor L.i.D. - The primary concern of <br /> the City, as indicated in our previous discussions and correspondence, <br /> is that until such time as public dedication of the P.U.D. right-of-way <br /> has occurred or other alternate publicly dedicated north-south access <br /> is developed, a permanent assurance that the potential for a North-South <br /> Traffic Corridor established along the easterly portion of your dient's <br /> property be provided. Two requirements must be met to provide the <br /> City with adequate assurance that such a north-south access alternative <br /> is made available and can be appropriately developed if the need arises. <br /> First, the property must be reserved from current and future develop- <br /> ment, and constructive notice to third party purchasers must be pro- <br /> vided. At this iime the City does not feel that conditions attached to <br /> the "Final Delcaration of Non-Significance" and the 6uilding Permit <br /> issuance will insure adequate constructive r.otic^ to third party purchas- <br /> ers, and a recorded document is the only means tiie City feels is adequate <br /> to provide such notice. An acceptable alternative may be for the appli- <br /> cant and the City to enter into a binding site pl::n agreement, but tli�s <br /> agreement would also require constructive Notice to future purchasers. <br /> `Ne need to further understand your concerns regarding the recorded <br /> document so we can at�empt to accommodate your needs, yet mai�itain <br /> adequate assurance the north-south access alternative will remain available <br />
