Our <br />.investigation into the cause of the 12/09/93 flood has included <br />an inspection of the interior of the drain culvert below your <br />parking lot by remote control video camera. <br />'Phe film produced by the camera shows that the culvert has been <br />pinched nea:ly closed at one point and has been partially <br />collapsed in another area. There are 4 to 5 2x4's wedged <br />vertically in the culvert to support the collapse which would <br />indicate that this is and was a known condition. <br />Our inspection of the culvert indicates that it has been <br />compressed enough to reduce the flow capacity of the culvert by <br />60�. This loss of ca�acity prevented the area north of the <br />Neilson Brothers parkinq lot from draininq properly, causing the <br />wa�er to back up and flood our insured's business. <br />The condition of the drain culvert is the proximate cause of the <br />flooding to our insured's business. Liability for the floodinq <br />uf 12/09/93 rests with Neilson Brothers as the property owner and <br />for failure to maintain the culvert. We will be submitting our <br />r�laim for damaqes to our insured's customers vehicles once their <br />claims have been concluded. Mr. Startup will also be submittinq <br />a claim for damages sustained but not covered by insurance. <br />['he culvert in its current condition presents a danqerous <br />situation for our insured as he is exposed to continued floodinq <br />if no actien is taken.
