Phase I: Food Market (Haggan's) <br />Haggan's shall conduct noiPe monitoring after the food market is occupied and <br />in norma] operation and shall submit the noise monitoring reports to t}ie CiCy <br />of Everett Planning Department. The noise moniCorii�g reports ahall be <br />prepared by a certified noise consultant and shall become part of the <br />environmental review record. At the conclusion of the monitoring period, <br />(vrtich shall be no longer t' :n six mo:ithe in duration, from the date of <br />isauance of the occupanry per .t), the noise report shall contain recommended <br />mitigation measures which m..c be taken to insure that operation of the <br />Haggan's Food Market is ir. compliance with City and State Noise Code <br />requirements. Haggan's ehall implement the noise mitigation ae3sures <br />contained in the reporC. <br />Additionally, prior to the issuance of an occupancy permit for the food <br />market, Haggan's shall post a bond in an amount to be deternined by the Public <br />Works Department, which shal.l insure that vitigatior, of worst case noise <br />impacts can be implemented. (These noise impacts and mitigation measures are <br />decumented in the existing noise study submitted by Haggan's). <br />Phase II: Home Center and Drug Store (Ernst and Pay 'n Save) <br />The home center and drug store shall comply with the previously defined <br />requirements uf Item 13, Noise MiLtigation, in [he "Final Declaration of <br />Non—Significance" issued on August 9, 1983; or alternatively ehall conduct <br />noise monitoring, implement mitigation measures based upon the monitoring <br />reports (in compliance with procedures required above for the Phase I portion <br />of the project), and post a bond based upon the costs of mitigating worst case <br />noise impacts generated by the home center and drug store. The bond amount <br />shall be based upon the noise analysis submitCed by Haggan's unless the home <br />center and drug store submit a new noise study for that portion of the site <br />within which their uses are located. <br />Variance Procedure <br />Additioaally, for either Phase I or Phase II, a variance from City and State <br />Noise Code requirements may be requested by the owners: the noise variance <br />(if grante�l b�� the Noise Code Administrator) would relieve the owners of <br />implementing mitigation measures required to insure compliance with City and <br />5tate Noise Code requirements prior to such time zs development actually <br />occurs an the vacant residentially zoned property to the north. At such time <br />as the vacant property to the north of the shopping center developa, thn Phase <br />I and Phase II owner would be required to implemen[ raitigation measures to <br />insure com�liance with City and State Noise Code requirr_-ments. <br />
