As a result of my telephone conversation with that department I wrote <br />for clarification regarding conveying road r/w. (Sce lett-er dtd. 7-13-84,) <br />Larry Crawford, Public Services Supervisor, responded (see lett-er dtd. 7-19-84) <br />with�a copy of an "Excerpt of E. ht. C. Title 13 as amended by Ordinance <br />555-78, 6G5-80 and 793-81. Section 2C was specifically sited. This Section <br />reads "All owners of properties shall dedicate additional rights-of-way as <br />necessary to complete the requirnd strect improvements in accordance with City <br />standards", The Public Works Deparlment has indicated a probable future LID <br />for street improveme�rts on 3rd Ave. If I would sign.an affidavit to the effect <br />that I would join in on a future LID - that would Ue satisfactory. In as much, <br />and as we are not asking for access off 3rd Ave. nor making any street improve- <br />ments, we hereby request an appeal, based on the following additional infor- <br />mation� and conditions: <br />1. That �ubject lot (Lot 2, IIlk. 14, Intercity Add., Div. N1) is an <br />_ established lot in an approved plat. Said plat included the <br />present 3rd Ave. 35' road riqht-of-way. <br />2 <br />3 <br />That a consideraUle amount of 3rd Ave. right-of-way remains to <br />be conveyed to the City between Everett [4a11 Way and 112th St. <br />That after acquiring right-of-�+ay along 3rd Ave., it may be <br />several years again pri.or to the opening of 3rd Ave. <br />9. That prnvious public works department sentiment was to open <br />3rd. Ave. via lnl:ercity Ave. which would connect South of our <br />property. It was also mentionr_d that in such a case, it was doubt- <br />ful that additional right-of-way would Uc required off our proyerty. <br />The 35' right-of-way being wide enough to service the 1 to 3 parcels <br />which would frontage this section of 3rd Ave. <br />5 <br />ti <br />L <br />I consider our present proposed use of our property as temporary <br />or as an inter.im usage.
