Conclusion: The impacts on public facilities have been addressed with the conditions <br />of approval and SEPA MDNS #06-077. <br />F. Phasing Plan — <br />Finding: The project has not been proposed to be developed in phases. If the two <br />commercial uses are developed at different times, the City may request a phasing plan from <br />the developer in order to ensure adequate access, fire protection, parking and utilities will <br />be provided for each phase. <br />Conclusion: Phasing plan not applicable. <br />NOW, THEREFORE, the City of Everett hereby GRANTS PRELIMINARY APPROVAL for <br />Binding Site Plan #06-004 with the following conditions: <br />1. Lot design/configuration for this Binding Site Plan shall be as shown on the preliminary <br />binding site plan map on file with the Planning/Community Development Department, <br />except as may be necessary to comply with reequirements identified in the "Information <br />for Developer" section of the Mitigated Determination of Non-Signi icance. Any changes <br />in lot design/configuration will require approvel by both Planning and Public Works <br />Departments. <br />2. The Following shall be noted as Conditions of Approval on the Final Binding Site Plan <br />Map: <br />a) The site must be developed per the Site Plan Exhibit "A" on record with <br />„ <br />the City of Cverett Planning and Community Development Department <br />(File - SEPA #06-077). <br />3. The applicant must provide for agreements for use and maintenance of common access <br />points, common parking, general circulation (drive aisles), utilities, landscaping, fencing, <br />required fire lanes, and access for all lots. These may take the form of Declaration of <br />Covenants, Easements, and Restrictions, to be recorded with or on the Final Binding <br />Site Plan Map. A note must be placed on the final Binding Site Plan Map stating, <br />"Declaration of Covenants, Easements, and Restrictions are recorded under Auditors <br />File # " <br />The project must comply with SEPA MDNS #06-077 dated June 21, 2007. <br />FINAL APPROVAL OF THIS BINDING SITE PLAN shall be given subject to the satisfactory <br />completion of the above-specified requirements and improvements within three (3) years. <br />There are no time extensions for this binding site plan. <br />APPEALS TO HEARING EXAMINER FOR BINDING SITE PLAN: <br />All appeals of decisions relating to Binding Site Plan shall be made to the Hearing Examiner. <br />Such appeals must be made in writing and filed with the o�ce of the fiearing Examiner within <br />fourteen (14) calendar days from the date on which the preliminary decision was rendered. <br />The written appeal shall include a detailed explanation stating the reason for the appeal. The <br />decision of ihe Hearing Examiner shall be final. <br />�S <br />
