T.hi� variance is necessary to nreserve the owner's enjoyment <br />of a�ubstanti�l nroperty right that is already available <br />per the Commercial Land U.e Goals and Gelieral Policies. <br />Within the near future the 3�J plus year old zoning code will <br />te reviewed which allows and encourages this type uf <br />building. The revised zoning code will allow bonuses of <br />height for quality development that �urpass the cities <br />minimum standards in C-1 or C-2 zone. These bonuses will <br />pruvide owners of C-•1 zoned property the right to surpass <br />the present l�eight limit of sixty five feet (65'). The <br />appellant's development is a high quality project which wi.11 <br />enhance this ar�a of the city. All zoning standa:ds have <br />been surpassed, ie., required landscaping, exce�s parking, <br />etc., thus the development would qualify for height bonuses <br />as stafied in the Commercial Land Use Goals and Ganeral <br />Policies. The appellant is ��estricted by the "time frame" <br />of construction, commitments to tenants and the city's time <br />schedule of rev3sing ihe zoning code. <br />C. The appellant's project is an addition to the Everett Mall <br />Office Park which has been designed and developed a� a <br />regional commercial center. TFe office park is sur�o�inded <br />by commercial develcpment. Everett Mall, a regional <br />shopping center, borders the park to the northeast. Everett <br />Mall Way is a major transportat.ion corridor with direct <br />connection to Interstate Five (I-5) and State Routa 526 and <br />Iiighway 99 (Evex�green Way). The project will enhance the <br />existing development, bring additional vitality to this part <br />of the city an3 provide economic develcpment to the <br />community. <br />The adRitiona.l ).�eight will cast a slightly longer sha�ow <br />than a sixty fiv�a foat tall building but the shaded area is <br />parking and landscape. The top fifteen feet (15') of the <br />building consis+ting of le�s than five percent (5X) of the <br />roof area will not impact shadowing beyond the roof. Only <br />the top nine feet (9') of the occupied building area would <br />create shading over that currently allowed. The plants <br />selected for the landscape area require shade. The shaded <br />parking area wil:l he desirable c;uring the summer months. <br />The building will be enclosed with Sunglas HP Reflective <br />Glass that is c;esigned to give reflective qualities while <br />ninimizirig the glare. This glass is designed to match that <br />used in the adjacent four 1eve1 building. The additional <br />neight above the four story building w311 not increase the <br />glare on the sur��ounding vicinity. <br />This project was designed to minimize the impact an the <br />environmeni whi.le enhancing the commercial development in <br />this area of the city. <br />.,�::::; <br />
