�. <br />Due to prospective tenant intereat in the building and <br />financing availabi].ity the owner would like to construct <br />the tao additional flocrs at thie time rather than wait <br />for the zoning code to change. This Would be more , <br />economical due to the fact that all the conatruction '', <br />equipment and oaterial are presently on eite. ; <br />Construction of the two (2) floors now would avoid future ' <br />aite disruptiona and inconveniencea to the occupants. I <br />Tlie appellant ca❑ not delay construction of the present <br />four story building until the zone code is revised due to <br />obligation with the major tenant of the building. When <br />the zoning code is revised, p+_ojects which provide <br />outstanding aite and building design will be allowed <br />certain bonusea above what the code would normally <br />allow. The current 30 year old zoning code should be <br />revise3 to reflect current construction methode of roof <br />mounted mechanical equipment, atreet elevatione in <br />relation to aite, and bonua for eite develcpment. As <br />� stated above, the upper fifteen feet (15') requeated in <br />the variance ia ior mechanical and elevator equipment. <br />The aite is aix feet (6') bzlow the atreet elevation. <br />b. Concluaion: There are exceptional or extraordinary <br />r.ircumstances applying to thie propertp because of the <br />fact that the Comprehensive Plan has been revised and <br />would allow the use proposed, but the zoning regulatione <br />have not yet been revised to implement the Comprehenaive <br />I Plan. <br />Criterion No. 2 <br />That auch variance is neceseary for the preservation and <br />enjoyment of a aubstantial property right of the <br />appellant possessed by tt;e owuers of other propertles in <br />the same viciaity or zone. <br />a. Finding: This property la designated "Regional <br />Commercial Center - Office Parks" by the Everett <br />Comprehenaive General Plan and the policie3 of thie <br />designation do a�pport an intensification of office and <br />retail activity in this area. However, the current <br />zoning code standards are not specific enough to create <br />the type of development called for in the General Plan <br />and a revision to the entire zoning code is neceasary to <br />properly implement the direction of the plan. <br />If the variance were not granted, the applicant would be <br />in effect penalized by the fact that the City hr- -�t yet <br />revised the zoning code to implement the policies of the <br />General Plan. <br />Thc applicant has committed to the citp that they willl <br />meet the criteria called for in the Ganeral Plan to� <br />qualify for the increased intensity of development as, <br />fol.lows: <br />1.
