f. "I f <br />The City provided written notice to all property owners within <br />300 feet of the subject property; no comments were received. <br />b. Conclusions: The proposed sign will be located adjacent to <br />the neighbors parking area and screened by existing <br />vegetation. The proposed location of the sign lakes into <br />account the desire to minimize view obstruction by <br />maintaining a clear vision triangle at the intersection of the <br />driveway and SE Everett Mall Way. The proposed variance <br />should not be materially detrimental to the neighborhood area <br />or the City as a whole. <br />Criterion No. 3: <br />That the variance will only grant the subject property the same genera' <br />rights enjoyed by other property in the same area and zone as the subject <br />property. <br />Findings: The sign currently on site was likely erected at the <br />time the fast food restaurant was constructed on site, which <br />was 1981. Subsequently, the code requirements for <br />installation of signage on site have changed. The sign on site <br />likely complied with code requirements when it was erected, <br />however it would not comply with current code requirements <br />related to height. There are several nonconforming signs <br />along Everett Mall Way. These include signs which are over <br />height, exceed sign area, or fail to meet required setbacks. <br />By allowing the new sign to be erected on site the applicant is <br />enjoying the same rights of neighboring properties and <br />businesses, by allowing themselves some form of public <br />advertising. <br />Everett Mall Way is host to numerous businesses that have <br />freestanding signs. Many of these signs do not meet the <br />current zoning setback requirements. The applicant is <br />proposing to install a new sign on site which will have the <br />ability to provide signage for the eight potential new tenants <br />on site. <br />b. Conclusions: The granting of the variance would permit the <br />subject property the same rights enjoyed by other properties <br />in the area. <br />Criterion No. 4: <br />That the variance is the minimum necessary to allow the subject property the <br />general rights described in Criterion 3. <br />(DO <br />
