w f a <br /> A <br /> WHEREAS,the City Council further finds: <br /> 1. The City's waterfront property has seen a profound change in use over the last 50 years, and <br /> will continue to change; and <br /> 2. The recently passed Shoreline Public Access Plan, having received much public input and <br /> support, clearly calls for increased public access to Everett's "world class" shorelines; and <br /> 3. The Port's proposal does show increased public access in the PDO area including early <br /> provision of near-water linkage between the existing marina and the 10th Street boat launch area <br /> next to the water; and <br /> 4. Current City land use policies and regulations would preclude the kind of positive public <br /> amenity that the proposed project can provide; and <br /> 5. The Port's proposal, as developed overtime, will meet or exceed the performance-based intent <br /> of the PDO ordinance with Development Agreement and Design Standards & Guidelines and <br /> would thereby provide an exceptional civic environment, enhancing the City's waterfront and <br /> overall image in the region as a place in which to live and invest; and <br /> 6. The Port's proposal to increase building heights in certain areas of the PDO area should only <br /> be approved in so long as views to Port Gardner Bay are not blocked any more than would be <br /> allowed under zoning heights in affect at the time of this action (M-S Zone); and <br /> 7. Requested amendments to the Shoreline Master Program to allow non-water dependent and <br /> related uses in the Shoreline Jurisdiction zone will need to also be approved by the State <br /> Department of Ecology in a subsequent action; and <br /> 8. The City desires to specifically change the regulations in the North Marina PDO-WC area as <br /> they apply only to the subject property; and <br /> 9. The City and Port desire to implement this proposed rezone through the City's Planned <br /> Development Overlay process and through the adoption and execution of a Development <br /> Agreement with Design Standards &Guidelines as provided in the Zoning Code; and <br /> 10. The proposed rezone will result in the property being developed for a combination of uses <br /> which are consistent with the Everett Comprehensive Plan and Shoreline Master Program as <br /> amended; and <br /> 11. The proposed rezone bears a substantial relation to public health, safety and welfare and <br /> promotes the best long-term interests of the Everett Community; and <br /> 12. The proposed rezone mitigates any adverse impacts upon existing or anticipated land uses in <br /> the immediate vicinity of the subject property; and <br />
