a <br /> 13. The proposed rezone will result in a project that is of a higher quality and more compatible <br /> and complementary to neighboring uses and, as such, will better implement the City's <br /> Comprehensive Plan; and <br /> 14.The Port's proposal will be enhanced by the early incorporation of increased public access; <br /> and <br /> WHEREAS, the City Council concludes: <br /> 1. The proposed change in use and increase in building heights in the north marina area, as <br /> proposed by the Port, is consistent with the intent of the City's Comprehensive Plan and <br /> Shoreline Master Program as amended for the overall site; and <br /> 2. The proposal meets all of the criteria listed in Chapter 29, Section 29.050 C of the Zoning <br /> Code; and <br /> 3. The proposal as modified by the conditions found in the Development Agreement and <br /> mitigation elements found in the non-project SEPA document for this action, will not have any <br /> significant impacts on the environment; and <br /> 4. Following this rezone action the Port will conduct a project specific Environmental Impact <br /> Statement process in which specific impact alternatives and elements will be identified and a <br /> preferred project action plan will be produced; and <br /> 5. The public will benefit from the Port's redevelopment of the PDO area with its <br /> complementary features enhancing the public use and enjoyment of access to the shoreline area; <br /> and <br /> 6. The surrounding property will not be detrimentally affected by the changes to the policies and <br /> regulations; and <br /> 7. The property depicted in Exhibit A, and described in Exhibit B, shall be zoned North Marina <br /> Planned Development Overlay—WC with a PDO-WC designation; and <br /> 8. The changes to the PDO-WC zone for this property bear a substantial relation to the public <br /> health, safety and welfare; and <br /> 9. The changes to the PDO-WC zone for this property promote the best long term interests of <br /> the Everett Community; and <br /> 10. The proposed rezone meets all of the criteria of the City's Zoning Code for PDO rezones; <br /> and <br />
