. ,, <br /> 11. The City encourages the Port to invite active public participation in the coming SEPA EIS <br /> process as it unfolds; and <br /> 12. The proposed rezone shall be implemented through a Development Agreement, with attached <br /> Design Standards & Guidelines as provided in EMC 19.41.160. <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br /> EVERETT: <br /> Section 1: Rezone-PDO Approval. <br /> The City hereby rezones the Port of Everett property depicted in Exhibit A and described in <br /> Exhibit B, with the Development Agreement as set forth in Exhibit C (attached hereto and <br /> incorporated herein by reference) to North Marina PDO-WC. <br /> Section 2: Modification of Regulations. <br /> In accordance with the PDO-WC approval provided in Section 1, the PDO-WC applicable <br /> regulations, including but not limited to, land use and height regulations, as modified, are set <br /> forth in the Development Agreement, Exhibit C. <br /> Section 3: Development Agreement with Design Standards & Guidelines. <br /> The North Marina PDO-WC zoning, as described herein, shall be implemented through the <br /> Development Agreement, Exhibit C. The development of the property described in Exhibits A <br /> and B shall be in accordance with the terms and conditions of this Resolution and the <br /> Development Agreement, Exhibit C, which the Mayor is hereby authorized to sign. <br /> Section 4: Recording. <br /> A copy of this Resolution, and an executed copy of the Development Agreement, shall be <br /> recorded with the Snohomish County Auditor's Office and shall constitute a covenant running <br /> with the land. All conditions and terms of this Resolution and the Development Agreement are <br /> binding upon the Port of Everett and their successors and assigns. <br /> Section 5. Corrections. <br /> The City Clerk and the codifiers of this Ordinance are authorized to make necessary corrections <br /> to the Ordinance including, but not limited to, the correction of scrivener's /clerical errors , <br /> references, ordinance numbering, section/subsection numbers,an• .ny references thereto. <br /> 0/1"/ .1(4 <br /> Council Member Introducing Resolution <br /> PASSED AND APPROVED THIS 17th DAY OF September 2003. <br /> Council President <br />
