• <br /> 12 <br /> WHEREAS,The Planning Commission held a public hearing on January 4, 2004 to consider the <br /> proposed changes to the Development Agreement; and <br /> WHEREAS, The Development Agreement provided for two `nodes' of retail development, <br /> including up to 3 acres at the intersection of Glenwood Ave and Sievers-Duecy Blvd., and up to 10 <br /> acres at the intersection of; and Hardeson Road and Sievers-Duecy Blvd; and <br /> WHEREAS, The Development Agreement and City of Everett Zoning Code require 10 to 15 feet <br /> of landscaping around individual buildings in the M-1, Office and Industrial Park zone; and <br /> WHEREAS,Rinker provide a written request that the Development Agreement be amended to <br /> allow additional permitted uses within the retail areas,and elimination of the requirement for <br /> landscaping around individual buildings within such retail areas. The additional uses requested <br /> include the following: <br /> • Glenwood Node: laundromat, shopping center; <br /> • Hardeson Node: appliance sales and service, bowling alley, carpet store, consumer <br /> services, espresso stand, laundromat, restaurants with drive-up window, shopping center, <br /> skating rink, veterinary clinic; and <br /> WHEREAS, The Planning Commission held a public hearing on March 15, 2005 to consider the <br /> proposed changes to the Development Agreement related to the retail nodes; and <br /> WHEREAS, The Planning Commission considered testimony at the public hearing related to the <br /> proposed amendments to the Development Agreement; and <br /> WHEREAS, The Planning Commission did find that the proposed amendments to the <br /> Development Agreement are consistent with the applicable review criteria in EMC Chapter <br /> 19.29.050 for planned development overlay zones as set forth in the staff report and testimony at the <br /> public hearing; and <br /> WHEREAS, Implementation of the Development Agreement between Rinker, FSA and the City <br /> will provide a substantial public benefit to the citizens of Everett through the creation of new park <br /> lands and office/industrial park development on a site previously used for aggregates extraction and <br /> processing; and <br /> WHEREAS,The City Council finds: <br /> 1. The proposed amendments to the Development Agreement are consistent with the applicable <br /> provisions of the Everett Comprehensive Plan; and <br /> 2. The proposed amendments to the Development Agreement bear a substantial relation to the <br /> public health, safety and welfare; and <br /> 3. The proposed amendments to the Zoning Code promote the best long-term interests of the <br /> Everett community. <br /> 53 <br /> 2 <br />
