12 <br /> yx � a xm <br /> CITY OF EVERETT <br /> CITY COUNCIL RESOLUTION NO. <br /> A Resolution Authorizing the Mayor to sign an Amended and Restated Development <br /> Agreement between Rinker-CSR(Rinker Materials), Food Services of America Inc. (FSA) <br /> and the City of Everett allowing dedication of additional property to the City of Everett; <br /> allowing additional small lots and additional permitted uses within `Designated Retail Areas'; <br /> and eliminating the requirement for building perimeter landscaping for lots within such retail <br /> areas. <br /> WHEREAS, On March 28, 2000, Rinker Materials, FSA and the City of Everett reached an <br /> agreement allowing redevelopment of approximately 320 acres of land comprised of an existing <br /> aggregates mining, asphalt and concrete production, landfill and pipe fabrication business; and <br /> WHEREAS, The Development Agreement established a Planned Development Overlay Zone <br /> (PDO) that contained specific mitigation measures and development standards for the Rinker and <br /> FSA property; and <br /> WHEREAS, The Development Agreement contained specific provisions for transferring certain <br /> parcels of land to the City of Everett for parks purposes within an established time period and the <br /> City has requested that the schedule for said transfer be modified such that all lots be finish graded <br /> and transferred to the City starting October 31, 2005 with completion by October 31, 2012; and <br /> WHEREAS,The City identified additional property within the PDO that could be graded and used <br /> for park purposes (i.e., Lots 45-D and 45-E) comprising approximately 27 acres; and <br /> WHEREAS,The Development Agreement allowed modifications of M-1 standards in Chapter <br /> 27.020 of the Zoning Code, including minimum lot size, landscaping and setbacks in exchange for <br /> providing a high quality office and industrial park development; and <br /> WHEREAS, Rinker has indicated a need for additional flexibility in marketing and developing lots <br /> for redevelopment within the PDO and has requested further modification of development standards <br /> in the M-1 zone (EMC Chapter 19.27.020), including <br /> • Creation of an additional lot less than 2 acres in size to be used for an electrical substation to <br /> meet the electricity needs of future development within the PDO; <br /> • Allowing creation of up to four additional lots a minimum of 2 acres in size; <br /> • Authorization of metal building materials, excluding corrugated metal, subject to review and <br /> approval by the Planning Director; and <br /> 1 <br />
