5 <br /> 31. All streets that are not private access points would be public dedicated streets. <br /> (exhibit 1) <br /> 32. The Donavan homes currently have a one-car garage with each unit. The <br /> placement of the Donavan homes on-site would result in a one-car garage with <br /> one available parking space outside the garage. The new units to be constructed <br /> on-site would have the standard two-car garage with two driveway parking <br /> spaces. Adequate parking is provided. (exhibit 1) <br /> 33. Open space is being provided on each lot. There would be significant open <br /> space throughout the project in order to preserve the buffer and wetlands. As <br /> noted, there are Category II and Category III wetlands on-site that are being <br /> preserved. (exhibit 1, Wood testimony) <br /> 34. Adequate notice consistent with State and local laws was given. (exhibit 1, <br /> Wood testimony) No testimony was submitted in opposition to the request. <br /> Jurisdiction: The Hearing Examiner of the City of Everett has jurisdictional authority to <br /> hold a hearing and to issue the decision. That authority is set forth in EMC 15.16.100. <br /> Based on the above Findings of Fact, the Hearing Examiner enters the following <br /> Conclusions: <br /> CONCLUSIONS <br /> 1. The Applicant requested approval from the City of a Planned Residential <br /> Development which includes a rezone from R-3, Multiple-Family Low Density <br /> Residential, to an R-3/PRD zoning designation. As part of the request, the <br /> Applicant sought approval of a subdivision creating 20 lots with 20 single-family <br /> dwelling units on 9.7 acres of land located at 2316 — 12th Street, Everett, <br /> Washington. The project would relocate eleven single-family dwellings from the <br /> Historic Donovan District to the northern portion of the subject property <br /> immediately off 12th Street. The other nine lots of the proposed subdivision <br /> would include new construction that would be subject to Small Lot Development <br /> Standards consistent with the Everett Municipal Code (EMC) 19.7.010. <br /> (finding 1) <br /> 2. In order for a preliminary plat for a subdivision to be approved within the City of <br /> Everett, the criteria as set forth in EMC 18.28.010 must be satisfied. These <br /> criteria are identified in finding #7. They have been satisfied consistent with the <br /> manner as set forth in findings #9 through #26. <br /> 3. The Planned Residential Development requires a rezone from an R-3 to an R- <br /> 3/PRD designation. The PRD would include relocations of the eleven single- <br /> family dwellings from the Historic Donavan District and result in an additional <br /> nine lots for new construction single-family homes.
