PART THREE—DEVELOPMENT PLAN <br /> 3.1 INTRODUCTION: <br /> Upon approval of the PDO,the provisions of this Agreement and the standards set forth herein <br /> shall govern and control the development of the Property. <br /> 3.2 CONTROLLING DOCUMENTS: <br /> Several codes, plans, policies and analyses provide the basis for the conditions contained in <br /> this Agreement. Where questions or the need for interpretation arise during the permitting or <br /> construction of improvements on the County site, these documents, as interpreted by the <br /> Planning Director, will control. <br /> A. Everett Municipal Code including but not limited to the Zoning Code(Title 19 <br /> EMC) and the Planned Development Overlay Zone(PDO) provisions. <br /> B. Everett GMA Comprehensive Plan <br /> The Planned Development Overlay zone was found to be compliant with the Everett <br /> Comprehensive Plan as required by EMC 19.29. An analysis of the Plan is found in the <br /> Supplemental Environmental Impact Statement prepared for the PDO proposal. <br /> C. Supplemental Environmental Impact Statement <br /> The City of Everett issued a Draft Supplemental Environmental Impact Statement (SEIS) <br /> on July 8, 2002. Comments were received from the public and a Final SEIS was issued <br /> on August 12, 2002. The FSEIS contains background material in support of several <br /> provisions of this Development Agreement. <br /> D. Air Quality Analysis <br /> MFG, Inc. conducted an Air Quality Analysis, issued March 8, 2002. The Air Quality <br /> Analysis describes the analysis conducted by MFG, Inc. to evaluate the potential air <br /> quality impacts that could result from the PDO proposal. <br /> E. Noise Analysis <br /> MFG, Inc. conducted an Environmental Noise Analysis, issued March 11, 2002. The <br /> Noise Analysis describes the analysis conducted by MFG, Inc. to evaluate the potential <br /> environmental noise impacts from Snohomish County's PDO proposal. Potentially <br /> significant sources of project-related noise were identified and discussed. <br /> F. Traffic Impact Analysis <br /> Pelted Engineering, Inc. conducted a Transportation Impact Analysis (TIA), issued June <br /> 2002.
