t <br /> t 1 <br /> The City rezones the County property described in Exhibit A(which is attached hereto <br /> and incorporated herein by reference)to B-3 with the Planned Development Overlay <br /> Zone (PDO) for the County Master Plan/Campus Redevelopment Initiative. <br /> Section 2: Modification of Regulations. <br /> In accordance with the PDO approval provided in Section 1,the B-3 height regulations as <br /> they apply to the jail and the B-3 landscaping regulations as they apply to the County's <br /> project are modified as set forth in the Development Agreement,Exhibit B (which is <br /> attached hereto and incorporated herein by reference). <br /> Section 3: Development Agreement. <br /> The B-3 PDO Zone, as described herein, shall be implemented through the Development <br /> Agreement. The development of the property described in Exhibit A shall be in <br /> accordance with the terms and conditions of this Resolution and the Development <br /> Agreement. The Mayor is hereby authorized to sign the Development Agreement. <br /> Section 4: Recording <br /> A copy of this Resolution, and an executed copy of the Development Agreement shall be <br /> recorded with the Snohomish County Auditor's Office and shall constitute a covenant <br /> running with the land.
