I. , <br /> 15. The parties hereto agree that, as conditioned by this Agreement, the County's proposed <br /> development of the Property satisfies the criteria for approval of alternative development <br /> standards under EMC 19.29.050( c ); and <br /> 16. On August 27, 2002, the Everett Planning Commission recommended approval of the PDO <br /> subject to certain performance conditions and subject to this Agreement and the associated site <br /> plan(hereafter known as"site plan"); and <br /> 17. The City Council approved the PDO rezone based on findings that: <br /> a. The Snohomish County Campus Redevelopment Initiative is consistent with and <br /> would implement the goals and policies of the 1994 Everett Comprehensive Plan; <br /> b. The CRI vision is compatible with City of Everett Design Guidelines as they are <br /> developed. The policies of the Comprehensive Plan pertaining to compatibility of <br /> land uses, downtown redevelopment, and urban design along Gateway Corridors <br /> were considered in the design of the Campus; <br /> c. The proposed rezone bears a substantial relation to public health, safety or <br /> welfare; and promotes the best long-term interests of the Everett community; <br /> d. The design of the Jail Expansion, Administration Building, parking garage, <br /> building remodels and urban plaza, as adopted in Attachment A, will be compatible <br /> with the surrounding neighborhoods and downtown core; <br /> e. The proposal, as developed over time, will meet or exceed the performance-based <br /> intent of the City's development standards in order to provide an exceptional civic <br /> environment; <br /> f. The Jail Expansion portion of the project will not involve establishing a new <br /> facility, but expand the identical use adjacent to the current location of the existing <br /> jail. The proposal is in compliance with the provisions of 19.46 EMC; <br /> g. Improvements in vehicular and pedestrian circulation through demand <br /> management, use of transit, signage and way finding, and accessible parking will <br /> mitigate the anticipated increased use of the County campus; <br /> h. The Responsible Official has determined that the Snohomish County Campus <br /> Redevelopment Initiative is an appropriate subject of Phased Environmental Review; <br /> i. The terms of this Agreement are sufficient to mitigate adverse impacts upon <br /> existing or anticipated land uses in the immediate vicinity of the subject property; <br /> j. The proposal is to ensure that all elements are completed at the same time in 2004. <br /> However due to the different construction schedules and time frames each of the CRI <br /> project components (Jail Expansion, Administration Building and parking structure <br /> and plaza) will proceed forward at different construction start times but are to be <br /> completed at approximately the same time; and <br /> 18. The Everett City Council approved the PDO rezone subject to certain conditions as described <br /> in this Agreement and site plan set forth in Attachment A; <br /> Now, THEREFORE,the parties herein do mutually agree as follows: <br /> PART ONE - INTRODUCTION <br /> Development Agreement Page 3 Snohomish County <br /> Campus Redevelopment Initiative <br />
