t , <br /> The City hereby adopts this Development Agreement in conjunction with the rezone of the <br /> property described in Part Two of this Agreement to a Planned Development Overlay in <br /> accordance with provisions of Title 19.41 Everett Municipal Code. <br /> The City and the County agree that the purpose of this Agreement is to comply with the Everett <br /> Municipal Code and the Conditions of Approval for the PDO Rezone. The City and the County <br /> further agree that this Agreement establishes certain rights of the County to develop the Property <br /> in accordance with the conditions specified herein and the approvals granted by the City with <br /> respect to the Project. <br /> The City and the County agree that each has entered into this Agreement knowingly and <br /> voluntarily and agree to be bound by its terms and conditions. <br /> It is the intent of this Agreement that all of the major components of the CRI will be completed at <br /> approximately the same time in 2004. The City and the County recognize that construction time <br /> among the different components of the CRI will differ and that some structures will actually take <br /> longer to build than others. To meet a coordinated completion date in 2004, the City understands <br /> that the jail and parking structure construction will start prior to the new administration building <br /> and the plaza on top of the parking structure construction. However, the County commits that the <br /> jail, the new administration building, the parking structure and the new plaza will open at <br /> approximately the same time in 2004. <br /> PART TWO —ACTION - PROPERTY DESCRIPTION <br /> 2.1 PROPOSED ACTION: <br /> The proposed action is the approval by the City of a Planned Development Overlay (PDO) zone <br /> for the property described in this section for the Snohomish County Campus Redevelopment <br /> Initiative (CRI). The PDO includes this Development Agreement and an associated Site Plan <br /> (Attachment A). <br /> The CRI is a multi-building master plan to create additional jail office space, and parking <br /> required to meet the County's growing needs in a setting that is conducive to efficient provision <br /> of services and engenders civic pride. The location of the proposed action is within the three- <br /> block area bounded by Lombard, Pacific, Wetmore Avenues and Wall Street. The plan includes <br /> the following elements: <br /> 1. Demolition of multiple buildings <br /> 2. Excavation of the site for foundation and site preparation work <br /> 3.
