eAt/S,m1 <br /> RESOLUTION NO. 5 2 33 <br /> A Resolution Amending Resolution No. 3592 as Amended by <br /> Resolution No. 4351, Granting a One Year Extension of an Intent <br /> to Rezone for a 2.9 acre site located at 310 W. Casino Road. <br /> (Green Drake Apartments formerly Casino Ridge Apartments) <br /> WHEREAS, Royal Flush Partnership represented by Marianne Christian-Griffith, <br /> filed an application to rezone property located south of SR 526, north of Casino Road, <br /> east of Hardeson Road and west of Upper Ridge Road from R-3 PRD (Multi-Family <br /> Medium Density Planned Residential Development)to R-3 (Multi-Family Medium <br /> Density Residential) for the purpose of developing a 36 unit apartment complex; and <br /> WHEREAS, a Resolution of Intent to Rezone was approved by City Council on <br /> January 29, 1992, with an expiration date of January 29, 1997, Resolution No. 3592; <br /> and <br /> WHEREAS, Homestead Alternatives, on behalf of Royal Flush Partnership, filed an <br /> application for a 5 year extension of the Resolution of Intent to Rezone, with a <br /> proposed revision to allow the zoning to revert to R-3, rather than R-3 PRD if the <br /> Intent to Rezone expires, and a request for wetland buffer width reduction and a <br /> height variance; and <br /> WHEREAS, a Resolution Amending the Intent to Rezone was approved by City <br /> Council on November 6, 1996,with an expiration date of January 29, 2002, <br /> Resolution No. 4351; and <br /> WHEREAS,while the subject property was developed in accordance with previous <br /> approvals and conditions, the development was not completed prior to the expiration <br /> date of January 29, 2002, as set forth by Resolution No. 4351; and <br /> WHEREAS, the current owner John Price, represented by Greg Blount/Driscoll <br /> Architects, filed an application for a one year extension of the Amended Resolution of <br /> Intent to Rezone; and <br /> WHEREAS, the Hearing Examiner held a public hearing and did adopt findings, <br /> conclusions and decision dated June 3, 2002, recommending to the Everett City <br /> Council that the proposed one year extension of the Amended Resolution of Intent to <br /> Rezone be approved pursuant to the provisions of Section 41.160.D 3(b) of Ordinance <br /> No. 1671-89, as amended, subject to the conditions of the decision; and <br />
