WHEREAS, the City Council finds that: 1. The rezone is consistent with the Everett General Plan; and 2. The rezone bears a substantial relation to the public health, safety and welfare; and promotes the best long term interests of the Everett community; and 3. The terms of the resolution are sufficient to mitigate adverse impacts upon existing or anticipated land uses in the immediate vicinity of the property herein described; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Everett that: Section 1: It does hereby adopt the Hearing Examiner's Findings, Conclusions and Decision dated June 3, 2002, hereinafter referred to as "Decision"which is attached hereto and incorporated herein by reference as Exhibit"A". Section 2: The Resolution of Intent to Rezone authorized by Resolution No. 3592 and subsequently amended by Resolution No. 4351 covers the property legally described below; Tracts 25 and 26, Beverly Homesites, Division 1, according to the Plat thereof recorded in Volume 10 of Plats, page 74, in Snohomish County Washington; except the south 35 feet of said Tract 25; and except the following parcel of land in said Tract 26; Beginning at a point 20 feet north of the southwest corner of said Tract 26; thence south 20 feet; thence east 40 feet; thence northwesterly 45 feet; more or less, to the point of beginning; also, except portion condemned by the State of Washington of State Highway SR-526 under Court Cause No. 93010 of the Superior Court of Snohomish County, State of Washington; and except that portion conveyed to the City of Everett by deed recorded under Recording Number 8303280307. Section 3: The time period for the expiration of Resolution No. 3592 as amended by Resolution No. 4351 is January 29, 2002. The expiration date of Resolution No. 3592 as amended by Section 4 of Resolution No. 4351 is hereby amended, granting an additional extension of one(1) year which shall expire on January 29, 2003. 2
