WHEREAS, the City Council finds that: <br /> 1. The rezone is consistent with the Everett General Plan; and <br /> 2. The rezone bears a substantial relation to the public health, safety and welfare; <br /> and promotes the best long term interests of the Everett community; and <br /> 3. The terms of the resolution are sufficient to mitigate adverse impacts upon <br /> existing or anticipated land uses in the immediate vicinity of the property herein <br /> described; <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Everett <br /> that: <br /> Section 1: It does hereby adopt the Hearing Examiner's Findings, Conclusions <br /> and Decision dated June 3, 2002, hereinafter referred to as "Decision"which is <br /> attached hereto and incorporated herein by reference as Exhibit"A". <br /> Section 2: The Resolution of Intent to Rezone authorized by Resolution No. 3592 <br /> and subsequently amended by Resolution No. 4351 covers the property legally <br /> described below; <br /> Tracts 25 and 26, Beverly Homesites, Division 1, according to the Plat thereof <br /> recorded in Volume 10 of Plats, page 74, in Snohomish County Washington; <br /> except the south 35 feet of said Tract 25; and except the following parcel of <br /> land in said Tract 26; Beginning at a point 20 feet north of the southwest <br /> corner of said Tract 26; thence south 20 feet; thence east 40 feet; thence <br /> northwesterly 45 feet; more or less, to the point of beginning; also, except <br /> portion condemned by the State of Washington of State Highway SR-526 <br /> under Court Cause No. 93010 of the Superior Court of Snohomish County, <br /> State of Washington; and except that portion conveyed to the City of Everett <br /> by deed recorded under Recording Number 8303280307. <br /> Section 3: The time period for the expiration of Resolution No. 3592 as amended <br /> by Resolution No. 4351 is January 29, 2002. The expiration date of Resolution No. <br /> 3592 as amended by Section 4 of Resolution No. 4351 is hereby amended, granting <br /> an additional extension of one(1) year which shall expire on January 29, 2003. <br /> 2 <br />
