All of the exhibits are available for inspection at the Hearing Examiner's Office located at <br /> 2930 Wetmore Avenue, 8th floor, Everett, Washington. <br /> After due consideration of the testimony and evidence presented by the Applicant, testimony <br /> and evidence elicited during the public hearing, and as the result of the personal inspection of <br /> the subject property and surrounding areas by the Everett Hearing Examiner, the following <br /> findings of fact and conclusions constitute the basis of the recommendation of the Everett <br /> Hearing Examiner. <br /> FINDINGS OF FACT <br /> 1. The Applicant requested approval of a one-year extension of an Intent to Rezone of a <br /> 2.9 acre parcel located at 310 West Casino Road, Everett, Washington. The original <br /> extension of the Intent to Rezone was granted on November 6, 1996, in City of Everett <br /> Resolution #43511. Resolution #4351 allowed for an extension and revisions to a <br /> previously approved Resolution (#3592) that had been approved for the site. <br /> Resolution #4351 granted the extension for an additional five years with an expiration <br /> date of January 29, 2002. (exhibit 1, Palacios testimony) <br /> 2. The original approval for development of the site included housing units developed <br /> with R-3 PRD standards; a wetland buffer width reduction for a 37-1/2 foot buffer from <br /> a riparian wetland located in the northwest portion of the site; a building height <br /> variance for the building height to be measured from the existing grade on-site, rather <br /> than measured from the base elevation of the site. The 1996 extension for the project <br /> was approved. The extension also provided that the zoning of the site would revert to <br /> R-3 from R-3 PRD if the Intent to Rezone expired. (exhibit 1, Palacios testimony) <br /> 3. Development of the site has occurred. (Blount testimony) The development, however, <br /> was not completed after the Resolution expired on January 29, 2002. The proposed <br /> extension will allow the Applicant to obtain final approvals from financial institutions <br /> and others, as well as permanently establishing the required width buffer and the <br /> building height variance. (Palacios testimony) <br /> 4. Everett Municipal Code (EMC) 19.41.140.D.7 sets forth the criteria for rezones. Those <br /> criteria include: <br /> A. The proposed rezone is consistent with the Everett General Comprehensive <br /> Plan. <br /> B. The proposed rezone bears a substantial relation to public health, safety, or <br /> welfare; and the proposed rezone promotes the best long-term interests of the <br /> Everett community. <br /> ' The approval was granted by the Everett City Council. <br /> 2 <br />
