The amount of the Security Deposit does not limit Landlord's rights or Tenant's <br /> obligations hereunder. The Security Deposit shall be deposited by the Landlord in a separate trust <br /> account with t _.. . IN NO EVENT SHALL TENANT BE <br /> .PERMITTED TO APPLY ANY PORTION OF HIS DAMAGE DEPOSIT TOWARDS HIS LAST <br /> MONTH'S RENT. Tenant understands that all or part of the Security Deposit may be retained by <br /> the Landlord upon termination of the tenancy and that a refund of any portion of the Security • <br /> Deposit to the Tenant is conditioned as follows: <br /> a) In the event that the Tenant vacates the Premises prior to the expiration of the term of this Lease <br /> Agreement, the Tenant shall remain responsible for the payment of rent for the entire term. However, <br /> Landlord will make all reasonable efforts to re-lease the apartment. Should the Premises be re-leased, <br /> the Tenant will cease to be responsible for payment of rent from the date of occupancy by the <br /> replacement tenant. In the event of Tenant vacating the Premises prior to the expiration of the term of <br /> this Lease Agreement, the Tenant agrees to pay the Landlord a $250.00 re-lease fee (to cover the time <br /> required to re-lease apartment)as well as all advertising costs. These costs are in addition to the normal <br /> "turnover" costs, as set out below in Section 6-in -addition to rent due on remaining lease term. The <br /> terms of the process for refund of a Security Deposit are set out in the attached Notice of Termination, <br /> which terms constitute part of this Lease Agreement <br /> b) Tenant shall clean and restore the Premises to its condition at the commencement of this tenancy, <br /> (less normal wear and tear), as evidenced by the Apartment Inspection Report signed by the Tenant <br /> prior to occupancy. Tenant UNDERSTANDS AND AGREES THAT THE LANDLORD SHALL <br /> HAVE THE CARPETS AND WINDOW COVERINGS PROFESSIONALLY CLEANED AT <br /> TENANT'S EXPENSE AT THE END OF THIS TENANCY IN ALL CASES. Tenant further agrees to <br /> pay for said cleaning as billed by Landlord or to allow such cleaning costs to be deducted from security <br /> deposit at the termination of tenancy. <br /> c) Tenant shall return to Landlord all keys provided during tenancy. Tenant UNDERSTANDS AND <br /> AGREES THAT THE LANDLORD SHALL HAVE THE APARTMENT RE-KEYED AT <br /> TENANT'S EXPENSE AT THE END OF THIS TENANCY IN ALL CASES. Tenant further agrees <br /> to pay for said re-keying as billed by Landlord or to allow such re-keying costs to be deducted from <br /> security deposit at the termination of tenancy. <br /> d) Tenant will be responsible for painting costs on the following prorated basis: <br /> If painting is required and tenant resided in unit; <br /> Less than 12 months the tenant will be responsible for 100%of costs. <br /> Less than 24 months the tenant will be responsible for 50%of costs. <br /> if Tenant smokes in apartment, all costs of re-painting will be paid by Tenant, regardless <br /> of duration of lease. <br /> e) Tenant shall have remedied or repaired, to Landlord's satisfaction, any damage caused by Tenant to <br /> the Complex, the Premises or the furnishings. <br /> f) Tenant shall have replaced any lost or missing items of furnishings or equipment, including personal <br /> property of the Landlord. <br /> g)Tenant shall have complied with all of the provisions of this Lease Agreement. <br /> h) Tenant shall have paid all rent and fees previously clue and payable under the terms of this Lease <br /> Agreement. <br /> A Security Deposit is a deposit for all purposes, but not limited to, unpaid rent,damage, cleaning, late payment, utilities, <br /> } keys and other charges. <br /> i <br /> .i. i 8 <br />
