7 <br /> AMENDMENT No. 1 <br /> PROFESSIONAL SERVICES AGREEMENT <br /> BETWEEN THE CITY OF EVERETT <br /> AND R.W. BECK Inc. FOR <br /> IMPLEMENTATION OF THE GENERAL CONTRACTOR/CONSTRUCTION MANAGER <br /> METHOD OF CONTRACTING FOR THE <br /> WATER POLLUTION CONTROL FACILITIES EXPANSION, PHASE A <br /> THIS AMENDMENT No. 1,to the Professional Services Agreement dated August 27, <br /> 2003 between the City of Everett, hereinafter referred to as "City," and R. W. Beth Inc., <br /> hereinafter referred to as "Consultant," is made and entered into this day of <br /> September, 2005. <br /> RECITALS: <br /> WHEREAS, the City and Consultant have entered into an Agreement entitled <br /> "Professional Services Agreement" between the City of Everett and R. W. Beth, Inc. for <br /> support, guidance and assistance implementing the General Contractor/Construction <br /> Manager method of contracting; and <br /> WHEREAS, the Professional Service Agreement species that the Agreement shall be <br /> completed by September 30, 2005; and <br /> WHEREAS, the City will benefit from the continued support of R. W. Becks, Inc.during <br /> the closeout of the construction contract; and <br /> WHEREAS, the budget in the Professional Services Agreement with R. W. Beth, Inc. <br /> does not need to be increased; <br /> NOW, THEREFORE, Consultant and the City agree to amend the Agreement as <br /> follows: <br /> I. SCOPE OF WORK <br /> The Consultant shall review,the project closure and preparation of the project report <br /> as directed by the City. <br /> II. SCHEDULE <br /> Section 3 of the Professional Services Agreement, "Time of Beginning and Completion <br /> of Performance", shall be amended by deleting, "September 30, 2005" and replacing it <br /> with, "June 30, 2007". <br /> III. COMPENSATION <br />
