13 <br /> ORDINANCE NO. <br /> AN ORDINANCE providing for the vacation of all of that portion of 105`h Street SE <br /> lying between Block 1 and Block 2, Plat of Silver Lake Garden Tracts, according to the plat <br /> thereof, recorded in Volume 8 of Plats, Page 17, records of Snohomish County, Washington; <br /> described as follows: <br /> BEGINNING at the Southwest corner of Lot 17,Block 1 of said plat;THENCE,East along the South <br /> line of said Lot 17 and Lot 18 to the Southeast corner of said Lot 18;THENCE, South along the <br /> Southerly projected East line of said Lot 18 to the Northeast corner of Lot 3,Block 2 of said plat; <br /> THENCE,Westerly along said North line of said Lot 3 and Lot 4 to the Northwest corner of Lot 4, <br /> Block 2 of said plat; THENCE,North along the Northerly projected West line of said Lot 4 to the <br /> Southwest corner of Lot 17,Block 1 of said plat, and the POINT OF BEGINNING <br /> WHEREAS the City Council of the City of Everett, did by Resolution No. 5207 duly <br /> adopt and fix the 10d' day of July, 2002 at 8:30A.M., as the date of public hearing; and <br /> WHEREAS, due and legal notice of the time and place of said hearing and determination <br /> of said Resolution has been given by the City Clerk in the manner prescribed by law; and <br /> WHEREAS, at the time and place fixed for hearing, the issues were publicly presented; <br /> and <br /> WHEREAS, the City Council finds it would not vacate said rights of way could it not <br /> retain easements for utilities in said street to be vacated; and <br /> WHEREAS, it now appears to the City Council of the City of Everett that the said rights <br /> of way resolved to be vacated should be vacated pursuant to the terms and conditions of this <br /> ordinance: <br /> NOW,THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: <br /> That the following described rights-of-way: <br /> all of that portion of 105th Street SE lying between Block 1 and Block 2, Plat of Silver Lake <br /> Garden Tracts, according to the plat thereof, recorded in Volume 8 of Plats, Page 17, records of <br /> Snohomish County, Washington; described as follows: <br /> BEGINNING at the Southwest corner of Lot 17, Block 1 of said plat; THENCE, East along the <br /> South line of said Lot 17 and Lot 18 to the Southeast corner of said Lot 18; THENCE, South along <br /> the Southerly projected East line of said Lot 18 to the Northeast corner of Lot 3, Block 2 of said <br /> 1 <br />
