9 <br /> WHEREAS,the City Council finds: <br /> 1. The proposed amendments are consistent with the Everett Comprehensive Plan; and <br /> 2. The proposed amendments bear a substantial relation to public health, safety or welfare; and <br /> promote the best long-term interests of the Everett community; and <br /> 3. The terms of the resolution of intent agreed to by the applicant and the City are sufficient to <br /> mitigate adverse impacts upon existing or anticipated.land uses in the immediate vicinity of <br /> the subject property. <br /> NOW,THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br /> EVERETT: <br /> Section 1. Amendments to Rezone Resolution No. 4123. <br /> That the Everett City Council Hereby Approves the Amendments to Rezone Resolution No. 4123 as <br /> follows: <br /> • Modification of the approved site plan to allow for a new gasoline sales facility,with related <br /> changes to the parking layout, storm water detention and treatment facilities and, alteration <br /> of the northern wetland on the site, including fill, mitigation and enhancement. These <br /> modifications are shown in Exhibit 1 which is attached hereto and incorporated herein by <br /> reference. <br /> • All mitigation measures and conditions that will apply to new gasoline sales facility <br /> approved herein are contained in the Final Mitigated Determination of Non-Significance <br /> dated August 30, 2005, and any subsequent addendums or revisions (SEPA #03-027-Exhibit <br /> 2 which is attached hereto and incorporated herein by reference). <br /> Council Member Introducing Resolution <br /> Passed and approved this day of , 2005 <br /> Council President <br /> 45 <br /> 2 <br />
