9 <br /> RESOLUTION NO. <br /> A Resolution amending Rezone Resolution No. 4123 and authorizing construction of a <br /> gasoline fueling facility at the existing Costco store site located at 10200— 19th Ave. SE and <br /> authorizing changes to the approved site plan,including parking layout, storm drainage <br /> facilities, access and wetlands. <br /> WHEREAS,Costco Wholesale submitted a rezone application requesting approval of a gasoline <br /> fueling facility and amendments to Resolution No. 4123 approved by the Everett City Council on <br /> June 7, 1995; and <br /> WHEREAS,Resolution No. 4123 authorized rezoning of the Costco property and construction of a <br /> 156,000 square foot retail/wholesale facility with 805 parking stalls subject to conditions; and <br /> WHEREAS,Resolution No. 4123 required the site be developed in conformance with the approved <br /> site plan as stipulated in the following language: <br /> Approved Site Plan—The subject property shall be used only for the development <br /> of Costco wholesale/retail facility per the approved site plan and the mitigation <br /> requirements and conditions listed herein. Minor revisions to the site plan which <br /> result in a lower intensity of development may be approved by the Planning and <br /> Community Development Director. However, in no case shall minor revisions result <br /> in increased impact on adjacent properties or environmentally sensitive areas; and <br /> WHEREAS,the City determined that the proposed changes to the site plan are not minor and <br /> would result in additional intensity of development and impacts not addressed in the Costco EIS; <br /> and <br /> WHEREAS,the City conducted a review of environmental impacts under SEPA and concluded the <br /> impacts of the proposal can be mitigated as set forth in SEPA MDNS #03-027 dated August 30, <br /> 2005; and <br /> WHEREAS,the Hearing Examiner held a public hearing on September 15, 2005,to consider the <br /> proposed amendments to the Resolution; and <br /> WHEREAS,after considering public testimony, the Hearing Examiner issued a written <br /> recommendation to the City Council dated September 29, 2005, that the rezone application be <br /> approved; and <br /> l 4 <br /> 1 <br />
