9 <br /> 30. Any rockeries or retaining walls proposed in required setback areas must be in conformance <br /> with Section 39.150 of the Zoning Code. <br /> 31. The Washington State Clean Air Act requires the use of all known, available, and reasonable <br /> means of controlling air pollution, including dust. Dust generated during construction <br /> activities can be controlled by wetting those dust sources such as areas of exposed soils, <br /> washing truck wheels before they leave the site, and installing and maintaining gravel <br /> construction entrances. Construction vehicle track-out is also a major dust source. Any <br /> evidence of track-out can trigger violations and fines from the Department of Ecology or the <br /> Puget Sound Clean Air Agency. <br /> 32. Installation of new underground storage tanks must meet the requirements of the new State <br /> Underground Storage Tank regulations (173-360 WAC). Copies of these regulations and <br /> required forms are available from the Department of Ecology by calling (206)407-7202, or <br /> toll-free in state 1-800-826-7716. <br /> 33. A notice of intent to install tanks must be filed with the Department of Ecology at least 30 <br /> days prior to installation. Within 30 days after coming into service, the tanks must be <br /> registered with the Department of Ecology on a state notification form. <br /> 34. All firms providing tank installation services must be registered with the Department of <br /> Ecology. The supervisor on site during installation must be licensed by passing an exam <br /> administered by the International Fire Code Institute or by another state with which <br /> Washington has a reciprocity agreement. Within 30 days after coming into service, an <br /> installation checklist form must be provided to the Department of Ecology by the company <br /> that performed the installation work. <br /> 35. If storage tanks contain dangerous or hazardous wastes as defined in WAC 173-303, please <br /> contact the Northwest Regional Office, Hazardous Waste and Toxics Reduction Section, at <br /> (206)867-7000 for closure requirements. <br /> 36. Stage I vapor recovery equipment is required on all new gasoline dispensing facilities with a <br /> total gasoline nominal storage capacity greater than 10,000 gallons. Also, a certified stage II <br /> vapor recovery system is required on all new gasoline dispensing facilities with greater than <br /> 10,000 gallons gasoline nominal storage capacity in western Washington counties (ref. <br /> Chapter 173-491, WAC, 6/93). <br /> 37. The existing transit stop on 19th Ave. may be in conflict with the proposed driveway <br /> location.
