Section 20 (H) of Ordinance No. 3572 (E•M.C. 79.70.080) was <br /> the controlling Ordinance at the tim� the variance was granted and <br /> rea�s as follows: <br /> H. Time Deci.sion Sffective. <br /> The decision oF the Board, granting or denying or denyind <br /> a v3riance, shall not becomz final until the expiration of five <br /> days from the date of entry of such decision in the ofiicial <br /> records of the Board, unless the 5oard shall find tnat the <br /> makin3 of the decision effective immediately is necessary for <br /> the preservation of property or personal rights, and shall so <br /> certify in th.e record of the request for special exception; and <br /> if a buildinR permit and/or occupancy permit is not obtained by <br /> the appellant within one year from the date of the Board's <br /> decision, tae Soar•d�s decisioa shall cease to be ef:ective. :he <br /> decision of the Board shall be final, subject to reviea by the <br /> 3u�=ri r Court. <br /> cXNlf3�it � � <br />
