proposed structure does provide for the required two parking stalls on
site, and could still meet this requirement if the structure were in
compliance with all zoning code requirements.
b• Conclusions: The ity provided written notice to ali property owners
within 300 feet of the subject site. No comments were received.
The proposed variance has been reviewed by the City Pubiic Wrks
and Building Departments. The following comments were received:
1) Building permits from the City are required for construction; 2)
Connect downspouts to sidesewer.
Criteri— °-- n N°• 3:
That the variance will only grant the subject property the same general rights
enjoyed by other properry in the same area and zone as the subject property.
a• Findincs: The applicant has stated that many properties abutting the
alley along the 1800 block between Lombard and Oakes Street have
garages which appear to be,located on or close to the rear property
line. Additionally, many of the accessory structures and residences
in the area are located either right on or very close to the side
Property line.
While many of the structures in the area may not comply with current
building setbacl<s, many of these structures could be certified as legal
non-conforming, indicating they were constructed prior to the code
standards in effect today. Upon review of the City's Permit Database,
no variance applications were found for properties within the
immediate vicinity of the subject property.
b• Conclusions: Aithough several structures in the area may fail to
comply with the required five foot side setback, and may exceed rear
yard coverage, it is likely that these structures were built prior to the
effective date of the Zoning Code which established these
requirements.
Criterion No. 4:
That the variance is the minimum necessary to allow the subject property the
generai rights described in Criterion 3.
a• in_ din2s: See Criteria #3.
b• Conclusions: See Criteria #3
Criteri0_5;
The granting of the variance is consistent with the goals and policies of the
Everett General Plan.
a• Findinc,s: The Everett General Plan designates this property as 1.3,
Single Family Detached, 10-12 Dwellings per gross acre.
b• Conclusions: The proposed use of the subject property for
residentiai purposes is consistent with tne Everett General Plan.
