Criterion No. 6: The need for the requested variance is not the result of a self- <br /> created hardship. <br /> a. Findings: The applicant has stated ihat the granting of the variances <br /> would allow for a new garage to be constructed in the same loation <br /> as the previous garage was on site, which was demolished <br /> approximately ten years ago. The applicant had planned on <br /> rebuilding the garage at that time, however construction was delayed <br /> due to various personal reasons. The pr�posed garage and location <br /> would allow for the storage of personal vehicies and equipment on <br /> site, while maintaining a useable backyard. <br /> The Board finds that there ia an existing residence on site whi�h faiis <br /> to meet the required side yard setback from the southern property <br /> line. They also find that the lot is substandard with regards to width. <br /> By locating the garage four feet from the southern property line, <br /> consistent wiih the nonconforming setback of the residence, there is <br /> still 13 feet of useable space on the north side of the proposed <br /> structure. The site is relatively level which would allow for the <br /> proposed structure to be moved eastward on the site 2.5 feet in order <br /> to comply with the rear yard coverage requirement of the Code. <br /> b. Conclusions: Although the lot is only 39 feet wide, there is still <br /> enough area to construct a two-car garage, and provide for storage <br /> space on the north side of the lot, as well as maintain a useable yard <br /> area between the residence and proposed structure. <br /> NOW, THEREFORE, the Board of Adjustment of the City of Everett does hereby <br /> order that the variance as requested by the applicant be DENIED and instead <br /> approve a four foot interior side setback from the southern property line. <br /> The action of the Board of Adjustment in DENYING a variance shall be final and <br /> conclusive, uniess within twenty-one (21) days from the date of decision an <br /> aggrieved person or persons obtains a writ of certiorari from the Superior Court of <br /> Washington for Snohomish County for the purpose of review of the action taken. <br /> DATED this 61h day of May, 2002. <J�/�� <br /> Chairman, Board of Adjustme <br /> Notes to Applicant: <br /> 1. If a variance is approved, builotng permits are required and must be <br /> obtained within one year from the approval date after which the <br /> Board of AdjustmenYs decision shall cease to be effective. Prior to <br /> the expiration date, a written request for a six-month extension may <br /> be submitted to the Planning Director. <br /> 2. A copy of this order must be submitted by the Applicant when <br /> applying for building permits. <br />
