Criterion No. 6: The need for the requested variance is not the result of a self-
created hardship.
a. Findin s: The applicant has stated that the granting of the variances
would allow for a new garage to be constructed in the same location
as the previous garage was on site, which was demolished
approximately ten years ago. The applicant had planned on
rebuilding the garage at lhat time, however construction was deiayed
due to various personal reasons. The proposed garage and location
would allow for the storage of personal vehicles and equipment on
site, while maintaining a useable backyard.
The Board finds lhat there is an existing residence on site which fails
to meet the required side yaid setback from the southern propc•rty
line. They also find that the lot is substandard with regards tc :vidth.
By locating ihe garage four feet from the southern property line,
consistent with the nonconforming setback of the residence, there is
still 13 feet of useable space on the north side of the proposed
structure. The site is relatively levei which would allow fer the
proposed structure to be moved eastward on the site 2.5 feet in order
to comply with the rear yard coverage requirement of tl2 Code.
b. Conclusions: Although the lot is only 39 feet wide, there is still
enough area to construct a two-car garage, and provide for storage
space on the north side of the lot, as well as maintain a useable yard
area between the residence and proposed structure.
NOW, THEREFORE, the Board of Adjustment of the City of Everett does hereby
order that the variance as requested by the applicant be DENIED and instead
approve a four foot interior side setback from the southern property line.
The action of the Board of Adjustment in DENYING a variance shall be final and
conclusive, unless within twenty-one (21) days from the date of decision an
aggrieved person or persons obtains a writ of certiorari from the Superior Court of
Washington for Snohomish County for the purpose of re•.iew of the action taken.
, DATED this 6`" day of May, 20Q2. %-o
Chairman, Board of Adjustme
Notes to Applicant:
1. If a variance is approved, building permits are required and must be
obtained within one year from the approval date after which the
Board of Adjustment's decision shall cease to be effective. Prior to
the expiration date, a written request for a six-month extension may
be submitted to ihe Planning Director.
2. A copy of this order must be submitted by the Applicant when
applying for building permits.
4
