� - <br /> Trinity Lutheran Church <br /> SPU #1-93 Page -6- <br /> DECISION <br /> Based upon the preceding findings of facts and conclusions of iaw, the testimony and <br /> evidence submitted at the public hearing, and upon the impressions of the Hearing <br /> Examiner of the site view, it is hereby ordered that the requested Special Property Use <br /> Permit for the day care facility at 2324 Lombard Avenue, Everett, Washington, is granted <br /> subject to the follawing conditions: <br /> 1. Detailed drawings in accordance with City Design and Construction Standards shall <br /> be submitted to the Public Works Department showing site parking layout, <br /> landscaping, utilities, storm drainage, temporary construction erosion control, and all <br /> required improvements in the pubiic right-of-way. Pu51ic Works Department <br /> approval of these drawings is required prior to any permits being issued. All <br /> improvements shall be completed, approved; and warranted before Occupancy <br /> Permits are issued. <br /> 2. A watsr/sewer connection fee must be paid at the time of Building Permit issuance. <br /> 3. A par;cing �;tudy prepared by the Applicant indicated that the existing 16 off-street <br /> parking stal:�, combined witli available on-street parking, would be sufficient for the <br /> proposed daycare. The Traffic Engineer and Planning Department concur with this <br /> finding. <br /> 4. Placement and screening of refuse disposal areas must be provided per Section <br /> 39.080 of the Zoning Code. <br /> 5. A no-fee lease must be executed for the portion of the right-of-way to be used as <br /> fenced piay area or required landscaping. <br /> 6. Landscaping must be provided around the perimeter of the site. However, because <br /> of the location of existing improvements on the site, it is not possible to meet the <br /> landscape requirements �f Section 35 of the Zoning Code (landscape category "B"). <br /> Therefore, landscaping must be pravided in the foliowing areas: <br /> a. Landscaping of the setback areas and excess right-of-ways must be provided <br /> along the Lombard Avenue frontage, including the five-foot strip between the <br /> sidewalk and play area. This area shall be planted with Type III landscaping. <br /> b. Landscaping must be provided along the north property line between the <br /> building and lot line. This area shall be planted with Type III landscaping, with <br /> exception that trees need not be planted. <br /> Note: The requirement to provide Type I or Type II landscaping along the north <br /> property line is waived due to the existing roof overhang, which effective!y prohibits <br /> growth of 4he required evergreen ;rees. <br />
