On October 6, 1998 the Director of Code Compliance sent Steven R. and Bazbara J. <br /> BarUow a letter, via certified and regulaz mail, notifying them that because of Steven <br /> Bartlow's conversation with the Building Official an appeal hearing was being <br /> scheduled and the City would temporarily cease demolition proceedings until a <br /> hearing of the case by the Boazd of Review. � <br /> onclusions of Law: � <br /> 1. Pursuant to Sections 16.12.040 and 1G.08.030 of the Everett Municipal Code the <br /> Boazd of Review has jurisdiction over this matter. <br /> 2. The buildings situated upon thc propeRy located at 3229A Wetmore Avenue and <br /> 3229B Wetmore Avenue in Everett, Washington(hereinafter"the buildings") aze <br /> residential. <br /> 3. Conditions exist at the buildings that are in violation of the Uniform Housing Code, <br /> as adopted by the City of Everett, and render thP buildings unsafe,dangerous or ; <br /> hazazdous. Said conditions are set out more fully in the Notice and Order for each <br /> buil�ing,which were admitted into evidence as Exhibits No. 4, 5 and 20, 7.1. <br /> 4. Conditions exist at the buildings that aze in violation of the Uniform Code for the <br /> Abatement of Dangerous Buildings, as adopted by the City of Everett, and render the <br /> buildings unsafe, d:.ngerous or hazardous. Said conditions are set out more fully in <br /> the Notice and Order for each building,which were admitted into evidence as Exhibit <br /> Nos. 4, 5 and 20, 21. <br /> 5. A sepazate Notice and Order for each building was properly issued and mailed via <br /> certified mail on June 19, 1998. <br /> G. The buildings were properly ordered vacated on June :9, 1998. <br /> 7. The buildings must be either demolished or repaired in accordance with all current <br /> building codes and all other applicable City of Everett codes, and within the time <br /> limits set forlh in the Notice and Order. <br /> 8. The City granted the extension of time requested in a July 1 G, 1998 letter from Steven <br /> R. and Barbara J. Bartlow to the Building Official. <br /> 9. The City properly notified Steven R. and Barbara J. Bartlow that the buildings are <br /> substandard and dangerous, that they had not obtained a permit by August 1, 1998 as <br /> they stated they would do in the July 1G`h letter, and that the matters were scheduled <br /> for the September 23, 19)8 City Council hearing for a resolution to demolish both <br /> buildings. <br /> l0. On September 23, 1998 the Everett City Council properly adopted a resolution <br /> pursuant to the Uniform Housing Code and the Uni!'orm Code for the Abatement of <br /> Dangerous Buildings authorizing the demolition and clearing of the buildings located <br /> at 3229A and 3229B Wetmore Avenue, eFwhich the property owners were notified.. <br /> ORDER <br /> Based on the Findings of Fact and Conclusions of law read into the record at the October <br /> 27, 1998 hearing of this appeal, the following Order is issued: <br /> 1. The o�vners cf the property at 3229A Wetmore Avenue and 3229B Wetmore Avenue <br /> in the City of Everett, Washington, shall comply with all conditions of each separate <br /> FINDINGS OF FAGT,CONCLUS[ONS 3 <br /> OF LAW AND ORDER <br />
