On June 19, 1998 the Housing Inspector posted the buildings with notices that it is � <br /> unlawful to occupy any poRion thereof. <br /> 6. On June 19, 1998 a separate Notice and Order of the City of Everett Building Official <br /> (hereinaRer"Notice and Order') for e:ch buildin�was issued and mailed via certified � <br /> mail to Steven R. Bartlow, Barbara J. Bartlow, Esther M. Brandsma and C.A. <br /> Brandsma. The receipts for said delivery were received by the Housing Inspector on <br /> June 25, 1998. <br /> 7. The Notice and Order for each buifding requires that the building sha;l either be <br /> demolished or repa:red in accordance with all current building codes and all other <br /> applicable City of Everett codes, and gives required dates for securing permits, <br /> physically commencing work and completing work. <br /> 8. The Notice and Order for each building provides that any person having any record <br /> title or legal interest in the building may appeal from the Notice and Order within <br /> thirty (30) days of service of the Notice and Order. <br /> 9. On 7uly 16, 1998 Steven R. and Bazbara J. Bartlow sent a letter to the Building <br /> Official stating that the building at 3229B Wetmore Avenue was secure again, that <br /> they had made application for a buifding permit, that their plans az� to demolish both <br /> buildings as soon as the permit is obtained and financing is available, and that <br /> building department staff had told them the permit could be ready by approximately <br /> August 1, 1998. <br /> 10. The Housing Inspector believes that the July 1 G, 1998 letter is a request for an <br /> extension of time and not an appeal of the Notice and Orders that were issued on June <br /> 19, 1998. <br /> I 1. On September l l, 1998 the Housing Inspector sent a letter to Steven R. and Barbara <br /> J. Bartlow, via certified and regular mail, giving them f:nal notice that the buildings <br /> are substandard and dangerous, that they had not obtained a permit by August 1, 1998 <br /> as they stated thcy would do in the July 16`h letter, and that the matters were <br /> scheduled for the September 23, 1998 Ciry Council hearing for a resolution to <br /> demolish both buildings. <br /> 12. The Housing Inspector did net receive any response to the September 11'h letter. <br /> 13. The Housing Inspector was at the September 23, 1998 City Council hearing and there <br /> was no one present identifying himself or herself as Steven R. Bartlow or Barbara J. <br /> Bartlow. <br /> 14. On September 23, 1998 the Everett City Council adopted a resolution pursuant to the <br /> Uniform Housing rode and the Uniform Code for the Abatement of Dangerous <br /> Buildings authorizing the demolition and clearing of the buildings located at 3229A <br /> and 3229B Wetmore Avenue. <br /> 15. On September 23, 1998 the Housing Inspector sent letters to Steven R. and Barbara J. <br /> Bartlow and C.A. and Esther Brandsma advising them that the resolution was <br /> adopted. <br /> 16. On September 25, 1998 the Building Official notified the Director of Code <br /> Compliance that he had spoken with Steven Bartlow and that Mr. Bartlow had <br /> mentioned an"appeal"and that he was requesting more time to demolish the <br /> buildings. <br /> PINDINGS OF FACT,CONCLUSIONS Z <br /> OF LAW AND ORDER <br />
