Public Comments <br />All of the exhibits are available for inspection at the Hearing Examiner's Office located at <br />2930 Wetmore Avenue, 8th floor, Everett, Washington. <br />After due consideration of the testimony and evidence presented by the Applicant, <br />testimony and evidence elicited during the public hearing, and as the result of the personal <br />inspection of the subject property and surrounding areas by the Everett Hearing Examiner, <br />the following findings of fact and conclusions constitute the basis of the decision of the <br />Everett Hearing Examiner. <br />FINDINGS OF FACTS <br />The Applicant requested approval of a Shoreline Permit for the development of <br />Rotary Park on the Snohomish River in the Lowell Neighborhood in the City of <br />Everett, Washington. The requested Shoreline Permit is for development of the <br />following: a two-lane boat launch into the Snohomish River; a 48 space parking lot; <br />a 900 square foot restroom facility; the creation of 12,000 square feet of wetlands to <br />replace 2,800 square feet of displaced wetlands; and approximately 4,500 cubic <br />yards of fill material needed to construct the boat launch and parking lot. <br />Previously, and under a separate Shoreline Permit, a 1,200 foot trail along the <br />shoreline of the Snohomish River was approved. .saw <br />2. The subject property is located within 200 feet of the Snohomish River. The <br />shoreline is a significant shoreline of the State of Washington, and a Shoreline <br />Permit is required. <br />3. The subject property to be developed along the Snohomish River consists of I <br />acres. The property north of the subject property is the Snohomish River; the <br />property to the west is vacant; the property to the south is agriculture; and the <br />property to the east is vacant. <br />4. The shoreline designation for the subject property is established in the Snohomish <br />County Shoreline Master Program. Since annexation into the City of Everett, the <br />subject property has not been addressed in the City of Everett's Shoreline Master <br />Program. Accordingly, the Snohomish County Shoreline Master Program controls <br />the review of this project. The Snohomish County Shoreline Master Program <br />designates the subject property as Rural Environment. <br />The proposed project is within 200 feet of the Snohomish River, and the proposed <br />development will exceed $2,500 in value. Pursuant to the Snohomish County <br />Shoreline Master Program, the Everett Municipal Code (EMC), the Washington <br />Administrative Code (WAC) 173-19-0004, and the Shoreline Act of the State of <br />Washington, a Snoreline 'ermit is required. <br />04 <br />
