There is no other reasonable use or feasible <br />alternative to the proposed development with less <br />impact on the environmentally sensitive area; and <br />2. The proposed development does not pose a threat to the <br />public health, safety and welfare on or off of the <br />subject lot; and <br />7. Any alterations permitted to� the requirements of this <br />Ordinance shall be the minimum necessary to allow for <br />reasonable use of the property; and <br />4. The inability of the applicant to derive reasonable <br />economic� use of the property is not the result of <br />actions by the applicant in subdividing the property or <br />adjustinq a boundary line thereby creating the <br />undevelopable condition afYer the effective date of <br />this ordinance; and <br />5. The . proposal mitigates . the impacts on the <br />environmentally�sensitive areas to the maximus� extent <br />possible. <br />In support of these findings, the.applicant has submitted <br />responses to the reo,uired. items listed under 37.o50.C, <br />including a wetland,delineation report.- These itens are <br />attached as Exhibit III. <br />Hased on the. submiLted information, the Planning Director <br />has determined per section 37.050.9.1.2 (Reasonable Use <br />Administrative Modification)�that: � . . <br />1. There is no other reasonable use or alternative to <br />the proposed development with lPas impact upon the <br />environnentally sensitive area. The existing R-1 <br />zoning allows�for only one single family unit upon the <br />property,�which is the�least intense "reasonable" land <br />use for this property. Other potentially "feasible" <br />alternatives to the proposed house such as transfer of <br />development rights do not work .for one. sinqle family <br />residence, since there is insufficient incentive for a <br />developer to provide an additional lot to the applicant <br />when the code provides for only a 20� increase over <br />that one transferred unit. Impacts to�the existinq <br />strean,. vetland and � buffer �vegetation will be <br />siqnificantly reduced by locating ��the proposed <br />structure within the most degraded portion of the site, <br />furthest away from the majority of the undisturbed <br />buffer and wetland areas. <br />
