ThE project is not located within the <br />stream floodplain or on slopes with hazardous soil <br />conditions. The proposed house footprint is located <br />on Alderwood soils, which are underlain by hardpan; <br />the applicant proposes to construct footinqs into to. <br />the hardpan layer. Furthermore, the proposed house is <br />conditioned by �this determination to be designed in <br />accordance with the recommendations of the soils report <br />prepared for the site: <br />7. Any alterations pernitted to the requireaent of <br />this Ordinance shall be the ainimus necessary to allov <br />for reasonable use of the property. No reductions in <br />required setbacks have been recommended. The buffer <br />setback for the proposed residence is being reduced <br />from approximately 100 feet to 25 feet. This is the <br />minimum buffer that oiill provide for a minimal <br />reasonable use on the property. The buffer for the <br />balance of the lot will either be enhanced or left <br />intact. <br />4. The inability of the applicant to derive <br />reasonable econouc use of the property is not the <br />zesult of actions by the applicant in subdividing the <br />property or adjusting a boundary line thereby creatinq <br />the undevelopable condition after the effective date of <br />this Ordinance. This is an established legally <br />subdivided lot. The entire lot has a� 258 slope <br />associated vith a riparian�wetland.and stream corridro <br />which classifies it as an Environmentallly Sensitive <br />Feature. As such, the property is not developable <br />undir the standard provisions of the City�s ESA <br />ordinances. Therefore, the applicant has undertaken no <br />action that makes�the subject site undevelopable. <br />5. The proposal mitigates the impacts on the <br />environmentally sencitive areas to the maximum extent <br />possible. Conditions have been �imposed upon the <br />project which will mitiqate any potential environmental <br />impacts. These include restoration and replanting of <br />the degzaded upper portion of the slope with native <br />specias, and compliance with the recummendations of the <br />project eoils report and a recommended execution of a <br />covenant to protect the site's environmentally <br />sensitive slope area. <br />Decision: The City of Everett Planning Direccor hereby <br />grants approval of the request by Paul Strome to allow.for <br />
