PLANNING DIRECTOR DETERMINATION <br />Fencc Modiflcation <br />Review Process I #03-027 <br />INTRODUCTION: The City of tverett Planning Department has received an application <br />from Bryan Burgen, 2208 F.9adison St., Everett, WA, 98203, to rnnstruct a five-foot high <br />solid cedar fence within the front yard setback. Section 39.070.A.1 of the Everett Zoning <br />Code grants the Planning Director the ability to permit a fence to exceed the maximum <br />allowable height of forty-two inches within the front setback, through Review Process I <br />as described in the Ciry's Local Project Review and Procedures Ordinance. <br />BACKGROUND: Section 39.070.A.1 of the Everett Zoning Code states that the <br />maximum height of fences located within the front yard setback shall not exceed forty- <br />two inches in height unless approved by the Planning Director using the review process <br />described in the City's Loral Project Review and Procedures Ordinance. <br />The subject propeRy is approximately 6,C00 square feet in area and is developed with a <br />single-family residence within the R-2 Single Family Residential Zone. The property <br />fronts on Madison Street with access to the off-street parking area from the alley behind <br />the residence. The applicant is planning on opening a family home daycare, with the <br />outdo�r play area located to the north of the residence. The applicant has provided a <br />letter from the DepaRment of Social and Health Services stating that the minimum tieight <br />of the outdoor play area enclosure shall be forty-eight inches, but recommends five feet <br />due to this residences proximity to a high traffic volume roadway. There is an existing <br />five-foot tail solid board fence within the front setback, however the applicant desires to <br />remove this oider rundown fence and replace it with a newer fence. Portions of both the <br />existing and proposed fence are located within the public right-of-way. <br />FI'JDINGS: The proposed fence would be five feet in height and contain a gate in order <br />to access the northern portion of the property. The subject site has an existing five-foot <br />tall fence located witnin the front setback. The intent of this fence is to provide a secure <br />outdoor play area for a propcsed family home daycare. - <br />DECISION: The Planning Director has determined to approve the application for the <br />fence modification based on the following conditions being met: <br />A five foot tall fence is permitted within the frcnt yard setback area however, any <br />portion of the fence exceeding forty-two inches in height shall be at least fifty <br />percent openwork in order to allow for the consistent free flow of light and air <br />through the framework (i.e. lattice, picket, wrought iron, trellis, or other similar <br />ornamental material) for the entire length of the fence. Chainlink and other types <br />of wire fencing are not encouraged. A clear visual exposure to the front of the <br />residence shall be maintained. <br />• The fence should not be taller than five feet from the sidewaik grade. <br />
