In addition to the Special Property Use Permit, the Applicant must also <br />secure a variance to raise the height of the antenna. to exceed the 35 <br />foot height limit imposed for R-3 zoned properties. The criteria for <br />variances as set forth in EMC 19.41.130.0 are: <br />(a) That the variance is necessary because of exceptional or <br />extraordinary circumstances regarding the size, sh:�pe, topography, or <br />location of the subject property; or the Iocation of a pre-existing <br />improvement on the subject property that confoRned to the Zoning Code <br />in effect when the improvement was conshucted. <br />(b) That the v�riznce witl not be materially detrimental to the property <br />in the area of the subject property or to the City as a whole <br />(c) i hat the variance will only grant the subject property the same <br />general rights enjoyed by other properly in the same area and zone as <br />the subject property. <br />(dj Th-� the variance is the minirnum �ecessary to allow ihe subJact <br />property t��e general rights described in Criterion C. <br />(e) The granting of the variance is consistent with the Goals and <br />Policies of thP Everett General Plan. <br />(f) The need for the requested variance is not the result of a self- <br />created hardship. <br />[] <br />
