Bartlett and seconded by Mr. Berg and unanimously carried to grent this <br />request for the following reasons: <br />I. That there are exceptional circumstances applying to the subject <br />property that do not apply to other properties in the same vicinity <br />or zone, specifically that tlie topographic condition on the property <br />is totally unique within the neigtiborhood and does no+ apply to <br />other parcels of land. <br />2. That the variance is necessary for the preservation and enjoyment <br />of a substantial property right of the appellant possessed by the <br />owners of other properties in the same vicinity or zone. Specifically, <br />that homes immediately adjacent to this property are closer to the <br />street than the required ���rty foot setback. <br />3. That the authorization of such variance will not be materially detri- <br />mental to the public welfare or injurious 4o property in the vicinity <br />pecifically that there will be a full twenty-five feet setbac�c from the <br />Pxisting right-of-way and 2) there will be no view obstruction for other <br />properties in i�he neighborhood. <br />4. He would like to expand his <br />house and had been advised by his architect that the addition of the one room <br />would be his best solution, since no additional land coverage would be required <br />and the new construction could be accommodated. He indicated that he wants to <br />keep the home small and keep it within the existing dimensions. <br />Mr. Graff asked if the garage was non-conforming. Mr. Shockey ind?cated that <br />while he did not know when the house was built he assumed it was prior to the <br />adoption of the new zoning and therefore the garage would be non-conforming.
