November 7, 1977 <br />The regular meetinq of the Everett Board of Adjustment was held at <br />7 p,m, in City ttall Council Chambers, City Hall, Everett, Washington. <br />Mr. Aussell presided; hfr, Kristiansen and Mr, Black were present; Mr. Herg <br />and Mr. Haird were absent. .. <br />Under old business, Ntr. Bliss Settergren was asking permission to <br />construct a single family residence at approximately 4918 23rd Avenue <br />W, and asking to build within ten (10) feet of the rear property line <br />rather than the code,requirement of t�oenty-five (25) feet. <br />Also permission to build within five (5) feet of the east side property <br />line rather than the required seven and one-half (7-1/2) feet. Since <br />Mr, Settergren's request at the October 3, 1977, meeting, some changes have <br />been made. Fte is now requesting that he maintain his seven and one-half <br />(7-1/2) foot side yard setback thereby meeting the code requirement, and <br />also that he stay within fifteen (15) feet of the rear nroperty line rather <br />than the twenty-five (25) feet tlie code requires. <br />Chairman Russell asked that the minutes covering 67r. Settergren's request <br />from the previous meeting be read. They were read and approved. <br />Mr, Aplet represented bir, Settergren. tie presented to the Board prints <br />showing the new location of the proposed residence and also the elevation <br />shots which were rnquested from the previous hearing. He stated that <br />the variance they were requesting aC this time was less tl�an they had <br />requested before and also that they felt there would be very little vicca <br />restriction from the surrounding neighbors with this ne�r proposal. <br />There was some oppositi�n from the audience and thcir main concern was <br />the variance principle being used. They felt that the twenty-five (25) <br />foot setback for a front yard should be maint.ained. Also they felt there <br />should be more information on the elevation <_hots that were presented by <br />Mr. Aplet. Mr. Aplet then explained further tt.e elevation shots that he <br />had tkaen. This seemed to answer the questions of the. audience. <br />With no further questions, the 3oard then went into session to mal:e their <br />decision. <br />After visually viewing the subject property and considering all Chz tacts <br />and testimony, it was moved by [•Sr. Kristiansen, seconded by Fir. IIlack <br />and unanimously carried to grant the variance as it meets the approval <br />of Section 19.70.060 of the Everett Municipal Code which states <br />1. That there are exceptional or extraordinary circumstances <br />. applyin9 to the subject property that do not apply generally . <br />to other properties in the same vicinity or zone. <br />2, That such variance is necessary for the preservation and <br />enjoyment of a substantial property right of the appellant <br />possessed by the owners of other properties in the same <br />vicinity, <br />3, That the authorization of such variance will not be <br />materially detrimental to the public welfare or injurious <br />to pro�ertics in thc vicinity, <br />
